Hello Kind VJ Users --

 

We're in the middle of perfecting our AOS, EAD & AP documents. 

 

Here's my situation:

  • My husband (i.e. Tom Sawyer) is my Primary Sponsor and he is submitting an I-864 along with the supporting documents. My husband will have no other person on his household so no one will be required to submit an I-864A together with him. 
  • My husband's sister (i.e. Jane Smith) is our Joint Sponsor and she is submitting another I-864 and her supporting documents. 
  • From reading our past documents during petition I-129F, in the co-sponsor's tax documents I read that my husband's sister (Jane Smith) filed her tax in a joint account with her husband, so on top of tho se tax document there are two names (i.e. John and Jane Smith)
  • Both John Smith and Jane Smith are working and are making income, they have joint account with their taxes. 

 

Now with Jane Smith file her tax jointly with her spouse, John Smith, my question is:

 

When Jane Smith, as Joint Sponsor, is filling her I-864's Part 1 (Basis for Filing Affidavit of Support) should Jane Smith put an 'X' on point 1.d. stating that she's 'the only joint sponsor'

 

OR

 

Would she chose point 1.e. I am the __ first __ second of two joint sponsor. and then her husband (Joe Smith) later have to also fill in a separate I-864???

OR

 

in Part 1. Jane Smith will chose 1.d. as 'the only joint sponsor' --- and later on Part 6. (Sponsor's Employment and Income) John Smith will be mentioned as the "Person 1" on her household and John Smith will have to complete the Form I-864A??

It is my understanding that Jane Smith is my ONLY Joint Sponsor and John Smith will be required to submit an I-864A as he is a member of Jane Smith's household? Am I correct?

 

Also does John Smith Has to submit these documents (separately from the Joint Sponsor) along with his I864A?

  1. Scan copy of his's passport and birth certificate
  2. his Most recent tax return 1040
  3. his Most Recent W2
  4. optional 2 previous year of Tax return and W2
  5. his Last 4 pay stubs
  6. his Letter of Employment

 

 

PLEASE HELP. MY HEAD IS HURTING FROM THIS :(

it depends if her individual income is enough to cover 3 people if they don't have any other dependents. if she makes enough, then she would put her individual income on the i864, plus W2s to show income, letter from employer, paystubs, and taxes, even if the total amount is from herself and her husband

 

in that case her husband doesn't need to file an i864A. if she needs to combine income with her husband to cover 3 people, then yes, he will need to file an i864A as her household member

 

it's passport or birth certificate, to prove they are USC or LPR, it would be copy of the green card. all that was mentioned, plus if her husband is filing the i864A, they would add, copy of marriage certificate, to prove relationship and proof of living in the same house

I think Just to be on the safe side, I will request that my sister-in-law's husband to fill out I-864A Form and submit the supporting documents. and thank you for adding Marriage Certificate on the list.
