Hello All,

 

I had tremendous success using this forum in helping bring my fiance (now wife) from Vietnam to Colorado (K1--> US Resident). I am hoping it can help in bringing my mother-in-law to visit us. 

 

BACKGROUND:

 

I am a naturally born US Citizen. My wife is a naturally born Vietnamese Citizen (now US Resident). We now have a 18-month old son (US Citizen). We own a small business (coffee shop), which is challenging to run while also taking care of our son. 

 

GOAL:

 

We would like to bring my wife's mother here for at least six (6) months to help watch are son, while my wife and I run are small business.

 

DISCUSSION:

 

With our small business we aren't really able to leave and go to Vietnam to visit my wife's family. We have lease restrictions, that do not allow us to close down. Also, were not really in a financial position yet to have gifts for all family members and travel expenses. We grossed ~$38,000 last year and we have not yet done are taxes yet. But basically we could write deductions to bring that number to ~$14,000 in net income (and thus get a tax return) or we could leave it as high as $38,000 and pay taxes (lose the refund) if that is necessary to show the embassy to bring her mom.

 

My wife's mother owns a very small business (manufacturing puppets by hand) and has a house that is worth ~700.000.000 VND although it is my understanding that the paperwork is not 100% in order. My mother-in-law is divorced and has two (2) other children in VN: one married (25) and one in university (21). 

 

With that what is the best way to proceed on getting her to come here to the US as soon as possible... tourist visa? some other way?

~~Moved to Tourist Visas, from Vietnam regional forum. - As from what the OP describes is the A tourist Visa may be the only option.~~

The thing about tourist visas is that they are for visiting. Babysitting is consider work even if it's grandma doing it. If your MIL did not come over you would either keep going as you have or hire a sitter.

She will have to show EXTREMELY strong ties to her country to get a visitor visa. Any other ways?  No, not legally.....

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Which may be difficult for a planned six month stay.

 

As others have said, a visitor visa is all about the visitor and the belief that they will actually leave before the visit time expires.  There is no way a USC or LPR can sponsor a visitor.  Also, as a visitor, she is not authorized to work, so babysitting is out of the question as that is considered formal work.  Lastly, a person can only apply for a visitor visa, if it is approved, CBP will set the expiration date upon arrival.

Actually, this is a cultural thing … mother assists in taking care of daughter’s children.

 

Whether people admit it or not … I feel it is fairly common to bring parents to perform unpaid childcare.

I would never trust a stranger with my child… sorry never going to do it. I’ve seen way too many things happen even in “Licensed” childcare facilities.

 

Obviously, we would never explicitly state that to a US Consulate/Embassy Officer…but from my experience they pretty much make predeterminations based on their feel of the situation. They could still approve tourist visa if they feel confident she will return to VN.

While in theory they might not ask about income… I have heard of individuals writing a “letter of responsibility” basically a US Citizen or US Resident stating they are responsible for XYZ individual and will provide food, housing, spending money etc. and then people getting approved.

That may be the case but they are well known to read VJ.
