Good day! 

My husband and I got married last month and we want to start the process of filing the Form I-130 within this month. I would just like to ask, in filling out the said form should my maiden name or married name be used? I saw forums saying that my married name should be used in the form. What worries me and my husband is item no. 47 in the said form which asks for my passport number. I already have a passport but it's in my maiden name. Is it okay if that's what we use in filling out Item 47 of Form I-130? I know others do that. But is it okay if we use my passport number from my passport which bears my maiden name then have my passport name change into my married name while the process of the I-130 is on going? Would that cause any problem or delay with our petition? I wanted to change my name in my passport before my husband files Form I-130 but there are no available appointments at DFA, earliest is September.

Yes its ok to change your passport. Think of it this way. Whether you have a MAIDEN name or a married both names identify you. Begin using your married name for all your documents UNLESS you're asked for your maiden name. Passport number will not change when you go to update with your married name. Relax. You're doing fine.

Really? My passport number won't change when I get a new passport bearing my married name? Most people say my passport number will change when I change my maiden name into my married name basically because I'm getting a new passport so that means a new passport number will be issued.

No it doesn't change. Besides let say it does change then you bring it to the interview and the CO will update your records. Can I suggest that you stay here in the PI forum and ask your questions. There are many here that have gone before you and can help. Reading other posts can sometimes give you a doubt.

I had the same concerns when submitting mine.  I was told over and over to make sure you put your maiden name in the other names you were known by section and to just make sure and update your passport by the time of your interview. I know that's already been said here but I wanted to lend a little backup to the posts here as that's what I was told by other members as well.

So what exactly did you do? Did you use you passport number from your passport that has your maiden name in filling out the Form I-130? And did you change your passport name into your married name while the process is on going?

That is exactly what my wife is doing.  I submitted her application using her married name (Seals) but the passport has her maiden name (Cole).  During the process, we will be having her passport changed to her married name. Again, just make sure on Page 5, Section 4, Question 5a-5c you put your Maiden name as another name used. (4a-4c will have your married name).

Its up to you if you will used your maiden name or change it to your married name. I don't change mine. My husband forwarded the I-130 in my maiden name (old passport), then I renew my passport still on my maiden name. passport number will change once you renew your passport. On the I-130 stage (USCIS), this is all about your husband proving if he is qualified to petition someone. Go and change your name if you like but for me,  all my documents and  assets is on my maiden name, there's no law telling you that you need to change your name once you're married to anybody.  On the NVC stage, this is another office. So you will fill out again another forms again.

What name is on your passport?  

 

After marriage did you go to DFA to have your passport renewed in your married name?   If not, it would be a good idea, it will make life easier for everything later.

 

You use the name in your passport for the I-130 process.   If you are in the process of renewing your passport in your married name.. then use that.

My maiden name is on my passport. I haven't renewed my passport yet because there are no available appointment at DFA, the earliest is September which is too late for us because we want to file this month.

You don't need the passport to file the I-130.  You can file using your married name, then while waiting get your passport renewed.   Life will be a lot easier, later, if you use your married name.
