Received NOA2 but Worrying Interview Isn't Gonna Happen

Hi everyone. I'm in a really tough situation which so far I have not been able to find any solution here on this forum so I'm posting this topic, really hoping someone could shed some lights on me. Any info would really really be so so so much appreciated. 

 

I'm a citizen of Malaysia who is currently living and working in Canada on a 12 months work visa. When we filed for our I-129F, I put the embassy location as Montreal because I thought since I'm here in Toronto it will be better if I don't have to fly home to Malaysia to do the interview later down the road. However, it's only now that I'm realizing my Work Permit in Canada is expiring on Aug20, 2017. 

 

Here's our visa timeline:

I-129F Sent :    2017-02-15
I-129F NOA1 :  2017-02-24   
I-129F NOA2 :  2017-05-23

 

So we already received our Noa2 on May23, 2017. We are now just waiting for NVC to send our case to the Montreal embassy and hopefully I get to be interviewed before Aug20. While there's a chance the visa interview could happen before my work permit ends, it's also very likely that it could happen AFTER. Which simply means my status in Canada will change from a foreign worker to a tourist when my work permit ends. This is really scaring me because I really do not know what does that entail? Will I still be eligible to be interviewed in Canada? :(

It is because I'm not a permanent residence of Canada, I'm just here on a 12months work visa. When it expires, my status will change, I just automatically assume I will be a visitor instesd of a foreign worker.

No I think you must leave the country before your work visa expires.  You do not suddenly become a tourist when your visa expires.  Read your visa.  I'm sure it has a date that it expires.

Thank you for pointing that out, it does make sense. Sorry, I should have known better.

 

Since I have to leave Canada before Aug20, what if the interview happens after? Should I just request for a change of location already? Any advise?

I'm sorry but I don't have the answer to that question but I'm sure someone will have the answer for you.  Just be sure you don't overstay...doing so could really mess you both up.  Good Luck and God Bless

You should request a change if you do not get a interview date by the 3Rd week of July.

If you think you will not be having your interview in Canada, you can request a change of the consulate from Montreal to Malaysia. Send NVC an email to request this. This is called a case transfer...

March 16, 2018 - I-485, I-765 & I-131 NOA Received

March 28, 2018 - Biometrics appointment

July 9, 2018 - EAD & Advanced Parole Approved

July 14, 2018 - EAD card Received

May 17, 2019 - I-485 Interview, Approved on the spot

May 23, 2019 - I-797 NOA on approval received

May 23, 2019 USCIS account updated to "Card picked up by USPS"

May 30, 2019 - US Permanent Resident Card Received

March 1, 2021 - I-751 Accepted

March 29, 2021 - I-751 NOA Received, US Permanent Resident Card extended for 18 months

NVC Received : some dinkelsberry yehoo in the house of clingons send our petition to the wrong consulate.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

you cannot assume any status in Canada Once your work permit expires, staying in Canada without any status is illegal. You may  opt to apply and  extend your stay as a worker or visitor in Canada or change your consulate in your home country.
