My wife and I got married over a year ago. She was born here in the U.S. We went to our first interview last summer, where I received my 2 year temp green card. Things have gone downhill. She has assaulted me twice already, this second time happened in February in where she fractured my wrist. She was arrested but I did not press charges because I loved her and she begged me not to as it would mess up her future teaching career. Soon after the case was dismissed she started hitting me again and cheating on me. I kicked her out. She has filed charges against me for harassment ( I kept contacting her asking her to help me pay my medical bills and surgery) She also filed a TRO the day I took her to court for my TRO. She said I abused her, hit her and a bunch of other lies. I am really scared as to what is going to happen with me. I am turning 21 in September, my mother is a perm resident and she is applying for her citizenship soon. My brother is a citizen and so is my aunt and cousin's. I've been in the U.S since I was 11 years old. I do not want to get sent back to my home country. This person is crazy and she is trying everything she can to get me in legal trouble and affect my second interview. I have not filed for divorce yet as I am waiting this TRO and the harassment charge to be over with.

I literally have no money for an attorney. I applied for the public defendant. Hypothetically, if I get something on my record (which I highly doubt it as I have never had trouble with the police) would that affect my second interview even if I get divorced under domestic violence?

Depends on the level of charge and penalty

Its great the charges were dismissed! Please stay away from your spouse as you dont want any more legal issues.

 

Your next step is to file for divorce. You can do this with or with out an attny. Check the date on your GC. You need to file for ROC before it expires. You can file up to 90 days before the date on the card. You can file early once you have your divorce decree, but even if you do not have it you need to file before the card expires.
