Timeline

Hello,

I am a April filer. I am a planner and I like to know that things are in order way in advance. With that said...2015 I worked part time and made about $16k for the year. Knowing that they need my 2015 tax return and it will show $16k should I also send in the co sponsor information when my financee goes for his interview, since I know they may request a co sponsor..or should i wait until they ask? I really don't want any hold up in the process..

You will need to submit a co-sponsor when your fiance marries you and adjusts, according to the USCIS:

 

"If your relative is either a “K-1” fiancé(e), a “K-3” spouse, or a “K-2” or “K-4” child of fiancé(e) or spouse, you do not need to submit an affidavit of support at the time you file your Form I-129F petition. Instead, you should submit an affidavit of support at the time that your fiancé(e), spouse, or child adjusts status to permanent resident after coming to the United States."

Thanks so much. that is good to know. I see alot of people saying when they went to the interview they took the affidavit of support..so I was just wondering.

I think that information is confusing. They are probably talking about form i864 that you use for AOS. However, you do need the i134 for the K1 at the Embassy stage. So yes, get your affidavit of support ready as it's required in the Embassy checklist.

 

Then I have a simple question... Why do you need to use 2015 taxes instead of 2016 that it's the last one filled? Because even if you want to collect tax transcripts from previous years, they actually ask for last year's. Therefore, 2016. :)

I thought they ask for last 3 years returns?

does the co sponsor fill out the same I134 form or is there a different form that say co sponsor?

I can't be 100% sure, but USCIS and about all the guides on K1 talk about last year's taxes... And usually related to self employed people.

 

However, I've seen my Embassy ask for the tax transcript and W-2 as a general thing, but they only mention last year's.

 

I understand people wanting to have as much support documents as possible. I'm doing that too, but maybe the three years are not required except in some difficult cases. I'm also hoping the employer letter is good proof of income, since my fiance got a much better job last July, though I read someone today being asked for a cosponsor due to low income in taxes, so I understand your confusion.

For K-1 you will need the I-134 and the MOST RECENT years of taxes. You do not need to send it off with the I-129F, but the foreign beneficiary will need it to take to their interview.

Any person sponsoring will need to fill out a I-134 and have supporting documents such as a tax transcript, or last years tax return/W2 combo, pay stubs, employer letter, and any proof to back up their financial ability. No need for bank statements unless you're using assets.

Timeline

My process took longer because of my divorce paper 1 year and 4 months. I do not know if you are from Haiti you know how their systems are it took me months to get the final divorce paper. When my husband went to his interview she gave her 221G paper because he did not have that.

I am in the US. My fiancee is living in Haiti. I was married before and did send my divorce paper with the intial application. I am hoping he is here by August.

They only need your 2016 income.

Here are the documents that my fiance sent to me:

- I-134 affidavite of support form.

- W-2 slips (year 2016)

- Form TC-40 States tax return (y2016)

- Form 1040ez Federal tax return (y2016)

- 1 year's worth of pay checks.

- 1 year's worth of bank statements.

- Employment letter. 

 

If you need co-sponsor, he or she needs to fill a seperate i-134 form, and provide those support documents, along with his/her photo passport, photo of birth certificate/ green card/ naturaliziation...

 

K1 VISA TIMELINE:

 

 

11/09/16 --- I-129F mailed to Lewisville, TX
11/12/16 --- Delivered at Dallas Lock Box

11/16/16 --- NOA1 Date on hard copy notice

11/17/16 --- NOA1 Text and Email. Case sent to CSC
