US Tourist VISA While Spousal VISA in Process

Hi Everyone,

 

I'm a US citizen who filed a spousal VISA on behalf my wife in India.  Our petition was filed in January 2017 and is in process.

 

I have a general question.  Knowing this process will take roughly 10-12 months would there be harm if my wife were to seek a US tourist VISA to visit me in the US?  

 

Would USCIS look at this action negatively?

 

Any insight would be appreciated.

If she has more ties to the US than India, then the chance for the tourist visa is slim.

I concur with the other poster on this as well. Especially from high fraud countries the chance for a B2 visa approval while a CR1 is processing is next to none.

I concur with the others. Obtaining a tourist visa from India is normally fairly difficult (>25% refusal rate last year), and doing so with an immigrant petition in process sets a higher bar. It's still possible, but you need to show sufficient ties to return home to overcome the implied immigrant intent and ties to the US (i.e. a USC spouse in the US).

Without a job she recently quit, chances of a b2 are slim to none, as someone with no incentive to return back to India and likely to be viewed as an AOS probable.
