ID CARD on K1 Visa

Timeline

My fiancee came in the US 1 week ago and we are getting married next month. On her K1 visa, there is an Alien number#. I would like to know if she can apply for an ID Card , while her documets are processed. This would help her get driving lessons and more...

More than likely you are going to need to get married and file for AOS with EAD + AP. Typically once the EAD arrives you may go to the DMV and apply for a license or ID card. My suggestion to you would be to go to the SSA, and apply for her first SSN card (of which she is eligible to obtain). This will help speed up the process a bit later on, so be proactive. Marry and file her adjustment documents. When the EAD arrives, take it and the SSN and any other requirements to the DMV as your evidence. She does not need an ID for being added to a bank account or even for health insurance - but unfortunately being able to drive legally requires a bit more evidence on the part of the state, and there's rules to follow. If she already knows how to drive or has a license from her home country she may even be able to fast track through some of the 'first time driver' hoops and get the state license within a week.

Timeline

The first thing your fiancé will most likely need is an SSN which they can apply for with her foreign passport and her I94 showing her K1 visa and entry into the US.  Most states require a SSN to get an ID card or drivers license, so I would work on that first.  Then check the requirements for the state you are residing in and gather that information and go to the DMV.  The only issue you will run into assuming you have all the required documents is that the ID or license will only be valid for the period of the I94 (90 days), but it does give her three months to gain some practice until you can go back with the EAD/GC.

Agree with the above posts about getting SSN before marriage in her maiden name.  she can change name later but keeps that SSN for life.

Thank you all for your answers. that was very helpful . We got married a week ago and we are waiting for the marriage license. We re about to file for AOS, EAD and AP.   I would like to ask: Should I send the marriage license along with the AOS and other documents ? 

Also what is the process for changing her name as she will carry my name ?

I believe you mean the marriage certificate. After it is registered by your county, you will receive a certified copy back, meaning the county certifies it is a true record from the county. You can make a photocopy of it for your AOS. Some people order extra certified copies to send with AOS.  Either is acceptable. To get a green card based on marriage to a US citizen, you have to prove there is a legal marriage. The marriage certificate is that proof. 

 

Once you marry, your wife has the option of using your surname immediately. Simply start using the name. Use it on her AOS/EAD/AP applications so those cards are issued in the name she wants to go by. Use it at the bank. Get it on the checkbook. Add it to your bills, lease. Add her as an authorized user of your credit card in her new surname.  At some point, you return to Social Security and get her name changed with them. I would suggest waiting until she has EAD or a greencard so her resident status can be updated at the same time. For anything that requires proof of a name change, you can show the marriage certificate.
