Yes it is possible if they are under 21. The kids will be filed as K-2.

For my I-129F, K-1, AOS, EAD, AP and ROC detailed timelines, please refer to my timeline page :)

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.

I see on the guides how to adjust status for a K-2. How do you petition for it? There is not a guide for that. What forms need to be sent along with the I-129F? She has 2 kids that want to come with her. They havent filed yet. Paperwork is being worked on now.

Each kid will need their own separate I-485 for AOS. You'll have to include stuff like:

 

  1. G-1145
  2. Completed  Form I-485
  3. 2 passport-style photos
  4. Copy of birth certificate
  5. Copy of passport page with non-immigrant visa, admission or parole stamp
  6. Copy of Most Recent Form I-94 Admission Record
  7. DS-3025 Medical Vaccination Worksheet 
  8. Latest Immunization Record (if available)
  9. Copy of  Form I-797C, Receipt/Notice of Action
  10. Copy of Approved Form I-129F (recommended to include this document since Alien # is in here)
  11. Copy of NVC Letter (if available)

Right now all that is needed is for the children to be included in the I-129f petition, filled out by the US citizen. Once the petition is approved, passes through the NVC and is sent to the embassy, they will need to apply for the K2 visa just like their parent applies for the K1 - that includes filling out form DS-160, provide all necessary documents and passport photos, do the medical and attend the interview. 

 

Once in in the US, they will need to file for AOS just like their mom.

05/21/2015 - Interview - Approved

03/13/2020 - Biometrics

02/02/2021 - Interview & test - Approved

02/05/2021 - Oath Ceremony
