Hi Everyone,

 

Need some inputs and suggestions please :) 

 

I will soon need to file my removal of condition so I'm gathering requirements. I'm missing some very important documents:

 

1. APARTMENT LEASE - We only have one apartment lease that our names are both there, something happened and we have to move out. On our current apartment lease is only in my name because of some circumstances we are not able to get one if we apply together. 

2. JOINT ACCOUNT - we used to have a joint account but we faced financial struggle that ended up the bank where our car was loan took the car and freeze our account. After that, we didn't open an account together to be safe.

 

Is writing a letter explaining the reason of why we don't have those and have it notarized enough? We have other documents like car insurance and health insurance both on our names. Our new car is only under his name and phone, electric and internet bills although not both on our names but in the same address.

Oh boy.  Well, once you move, you can both go and update your address with the MVA.  It's a quick and easy process.  Best wishes!

A notary says nothing more than you legitimately signed a piece of paper.  A notary has nothing to do with the legitimacy of what's written on paper.  I can get a notary stamp on a piece of paper that I signed proclaiming I am Batman.  A notary certifies the signature, not the contents of the paper.  So no, having a notarized letter explaining your circumstances will not help.   

The burden of proof to show a bonafide, legitimate marriage is on you guys.  Think like an adjudicator, and leave no doubt in their mind that your marriage is bonafide.  Or, risk a Stokes interview.  Or worse, a denial.

If you haven't already, read the tips section on removal of conditions. VJ has provided great examples of evidence to provide your bonafide marriage:

1. A deed, showing co-ownership of your property or a lease agreement with both of your names on the
lease.
2. Utility bills, credit card bills, and other types of bills which have both of your names on them. Since many utilities will only put a bill in one person's name, some bills in one name and other bills at the same address but in the other spouse's name serve the same purpose: showing your financial & social lives intermingled.
3. Copies of actual credit cards, health insurance cards, or other "joint" cards that you have together,
showing same account number.
4. Car, health, or life insurance that has both of your names on the policy or the other spouse listed as the
beneficiary.
5. 401K or other retirement plan with spouse listed as beneficiary (right to survivorship is the technical term)
6. Bank or stock accounts with both of your names on them.
7. A copy of your joint federal and state tax returns (including W-2's and other applicable Schedules and attachments). Sending an official tax transcript from the IRS (for Federal) is beneficial and often preferred as it reflects what was actually filed.
8. A car title or other titles to property showing joint ownership with your spouse.
9. Birth certificate of any children that have been born to your marriage.
10. Documentation of any vacations that you have taken, including flight itineraries, hotel bills, pictures of you
together on vacation.
11. Other family pictures of you together.
12. Documentary proof showing evidence of your children together (Copy of Birth Certificate, photos, etc)
13. Copies of Christmas cards and other holiday cards addressed to you both

we do have 401K, health insurance and other important documents I'm just worried about the bank and the lease. And yes I will have our driver license change. I did told him that long ago but he doesn't want to ughh. Now he has too

Just an update:

 

So I'm almost done with my papers just waiting few papers...we really did try our best to get those bank statement but it fail. I am wondering if they will question us since we don't have a current lease together (some problem w/ his credit) and bank statements. But we have the rest insurances and 401K. Will I received RFE cuz of that?
