Form i-864

The petitioner (my spouse) is currently unemployed, so he will include his Mother’s income to meet the income requirement.

Beneficiary (me), Petitioner (my spouse), and Petitioner’s Mother all live together.

Is the petitioner’s Mother a HOUSEHOLD MEMBER or JOINT SPONSOR or BOTH?

She's both. Your spouse need to fill out i864 although he is unemployed and his mom need to fill out i864a since you all live together.

Ok, thank you!

So, if I've understood it correctly; my spouse has to fill out i864, his mother i-864A and also her own i-864 (since she is also joint sponsor), am I right?

She will fill out only one and that is the i864a. I864 and i864a is the same thing. But because the joint sponsor live with you it has the A at the end. If his mother didn't live with him, she would have fill out the i864.

Ok, that makes sense! Thank you for clarifying:)

Hello, I have the same case. I petitioned my husband and I live with my mom who is also his joint sponsor. I did NOT file an i864a but i did file an i864 for my mother and myself. I did this because my mom never claimed me on the tax, but then someone told us we had to file the i864a and will probably get a checklist since we didn't. We did not end up getting one.

We had our case completed by NVC last March 13.

09/24 - Sent out I-130 to Phoenix, AZ

09/26 - Received at Phoenix (somewhere in between, the I-797 was mailed and marked back to sender due to post office error)

10/24 - Finally got the I-797 NOA-1 resent to me - forwarded my case to NSC

11/04 - Status changed to RFE

11/12 - Got the RFE letter in the mail (certified copy of marriage certificate)

11/18 - Mailed in RFE response

11/21 - RFE received at USCIS

11/21 - RFE status changed to response review

11/29 - Case approved at USCIS

12/03 - Received NOA-2 in the mail

12/09 - Case sent to NVC

12/15 - Case received by NVC

12/20 - NVC case number and IIN assigned

12/21 - DS-261 submitted online & gave email addresses

12/22 - Had NVC review DS-261 over the phone, paid AOS fee

12/24 - Paid IV fee

12/28 - Submitted DS-260

12/29 - Submitted packet to NVC via FedEx

01/03 - Packet delivered to NVC
