Hi everyone,

I'm new to this site, it was suggested to me yesterday by a lady I met at my interview... I went for my interview yesterday and it went ok , though I wasn't approved the CO asked that I get a joint sponsor to add to my petitioner before he would approve my case.. The problem is my wife's annual income adds up to $32k (plus state subsidy and disability), which put her above the poverty line. the lawyer handling our case didn't add up the affidavit to show the money earned from the state subsidy and disability which put her below the poverty line and the CO indicated that to me at the interview. I had her 2016 tax returns and financials and suggested I could show to him to prove she is above the poverty level but he refused and said I need to get a joint sponsor and he will approve the visa. handing me a paper and my passport to send the documents  and my passport through DHL to him and he will approve my visa.

 

Now my problem is can we ask our lawyer to prove that to the CO and will that make our case be approved?

How much time do we have to get the documents sent to the CO,since the sponsor we asked for his help had already sponsored 4 other individuals and said his attorney said it wouldn't be wise to go forward to it.

Can your members please she your thoughts and ideas as to the way forward please.

Ask someone else to be a joint sponsor. Could be any LPR\USC with a source of income, a friend, coworker, etc.

Unfortunately my wife doesn't have anyone to ask. We are at a stand still now.... She is trying to take a different route by asking the lawyer to get in contact with the CO to change his decision about needing a joint sponsor by showing she is above the poverty level... I really don't think that's a good thing to do since he mentioned we need a joint sponsor.

How would wife support you while on disability?  

Got no choice; if CO asked for a alternate sponsor better get an alternate sponsor.

If you have assets, you can supplement the difference between your wife's income and the poverty guidelines with that. It needs to be three times in assets. 

 

Take away the disability and subsidy (since this seems to be what the CO don't like) and then deduct the remaining amount against the poverty guidelines. Take the difference times three and then some, and that's the amount you would need to show in assets. The assets can be in your name and in your country.

The requirements for a sponsor are that they are a US citizen or legal permanent resident and that they meet the income level for the household size.   It does not matter in which state they reside.

Check with Embassy by what time you have to Send Documents..It's around 3 months you had Interview right..Good Luck ! Brown

Your Lawyer might be correct.

I know with NVC its every  1Year we have to contact them.But I don't know about Embassy
