Do I need to submit 2016 tax returns?

I am in the process of filing my taxes for 2016 and I am my wife's petitioner for a CR-1 visa. I am getting documents ready to submit to NVC in the coming month. I have two questions:

 

1) Will NVC require either my or my cosponsor's 2016 tax transcript, even though taxes aren't due for another month and a half, meaning I would have to wait until the 2016 tax transcript is available to submit documents to NVC?

 

2) Is it required to have either my or my cosponsor's tax transcript for 2016 at the interview? I ask because I don't know if our tax transcripts will be available in time for the interview.

7/27/2016: I-130 mailed.

8/02/2016: NOA1.

2/17/2017: NOA2.

2/24/2017: I-130 sent to NVC.

 

NVC

3/03/2017:  I-130 received.

3/09/2017: Case # and invoice # received, AOS and IV fees paid.

3/16/2017: DS-260 submitted; AOS and IV packets sent with EP.

4/06/2017: Case complete.

 

Consulate

4/15/2017: Interview email (P4).

5/09/2017: Medical.

5/15/2017: Interview.

5/19/2017: Visa in hand.

Timeline

Most likely, especially if your 2015 tax transcripts did not meet the minimum requirements.

 

So far it seems a lot of people have been asked for the 2016 transcripts for different processes.

08/15/2014 : Met Online

06/30/2016 : I-129F Packet Sent

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

I ask because I am seeing contradicting answers all over this website. You say there is evidence that suggests I now need to wait until those documents are available to proceed with the NVC paperwork. I went to the NVC wiki and read the following, which is a year behind with the dates but the same info applies:

 

"Do I have to file 2015 taxes before I can fill out the I-864 form?

No. Up until April 18th, 2016 (tax deadline), you can still use 2014 as the most recent tax year. If for whatever reason you want to use 2015 as the most recent year instead (due to whatever reason), then yes, you can use 2015 as the most recent year as well. Both are valid options.

Keep in mind though: if you submit 2014 tax information as the most recent year and your interview is scheduled after April 18th, then 2015 tax information will likely be required at the interview."

Definately do and the whole process can be contradicting as it really comes down to the person reviewing your file. They can make a request for any piece of information honestly.

 

I would proceed as you are right now but do not be surprised if they were to ask for a copy of it. Just get those taxes done in the mean time.

Thanks for your response. The consensus seems to be that I can submit the completed tax return, instead of the tax transcript if it is not yet available, to NVC and then take the transcript to the interview. NVC will be satisfied with that evidence and then the interviewer will review the tax transcript later once it is available.

I submitted my documents to NVC on December 2nd so I didn't send my husband's 2016 tax return as it was kind of early. I got CC yesterday, March 1st. I am waiting on an interview date now. If for some reason my interview is scheduled after April18th, will I have to bring those documents to the interview?

You will most likely need the 2016 tax return if the interview is after April 15, based on what people on VJ have said. I have been told that to be on the safe side, it is a good idea to file 2016 before the interview, even if the interview is before the tax deadline.
