I was taken to a police station when my then 3 year old who woke up from a nap got out of the house while my infant son and i was asleep. I was at the police station for a few hours questioned and released. I wasn't charge, no court and no convictions. Question is how do I know if I have a record or how should i go about getting the information and proof of no conviction or court disposition? In the application it says "if you have been arrested,detained etc. you have to provide a proof of court disposition. I live in oregon now and I have to renew my greencard soon. And I need advice for this.

Hi I honestly don't know? This was 8 years ago.I was handcuffed and taken to the police station ( does that mean I was arrested?) I was questioned and after 8 hours I was finger printed and photo taken. I was released and I didn't need to go to court and I wasn't convicted or no charges was filed. Whats is the difference between arrest and detained? I have never been the type of person to get in trouble and I didn't mean for my daughter to get out of the house.

sounds like you were just detained.

 

just write everything down for them and state that you think you were detained and that is all but are not sure. might also be good to get the police report from the incident.

If you were fingerprinted then you were arrested.

 

Contact the arresting agency seeking a letter indicating that no charges were filed.

Only in America, land of mass incarceration, will a parent get arrested because their child snuck out. Insane....

 

Normally, when they take your picture and fingerprints, you're getting arrested. 

 

Contact the court clerk in the county where you were arrested. They usually have the answers or can point you in the right direction.

call the police office where the incident happened and get a record from them. If you didn't have a court date or charges you won't find anything in the court system.

Slowdown ...you were detained, questioned & released,

make sure you disclose thar, had it not been sorted out

then they would have brought in CPS. You can apply for

new GC it should not be a probm but in light of current

situation apply as soon as you can,

They had taken my kids for a day and I didn't see them. It was just a very scary and crazy situation.CPS told me I have to do a month long parenting class. I had move back to my home state and transfer the case. They visited me ones and that was it!

It was very scary. There were so much going on at the tine. I was scared for my kids and I thought I will not see them again! Thank you for your advice!
