SSN, name change, and filing taxes

Hello all,

Soon we will be preparing for tax season, and want to file joint return but my Wife's SSN still in her maiden name (we just sent AOS packet last week) - is it true she can't change her name on SSN card until she gets her EAD or green card? Does anyone know if we can still file the tax forms if her name on SSN hasn't been changed yet?

Yes you can still file taxes if her SS card shows her maiden name.

I don't know about the EAD cars being needed to change her name or not. You could always just go to the SS office near you and inquire. Take all documents with you.

I haven't been able to change mine, I went in to do it after we were married and again when I didn't hear anything 6 weeks later to be told that they get locked out of making changes once the AOS is in process and to wait until I have my GC. However, I have heard that you can change your name once you have your EAD but I haven't gone back yet. I may do tomorrow and see what different things I get told then!

I will not look back on this journey with fond memories, but I will look back knowing that every step was worth it, whatever the outcome.

By tax time you should have her EAD, if you already filed AOS so you'll be able to file.

If not, simply file taxes with her maiden name.

Success! after two hours of waiting...

We decided to go to SSN office yesterday to see if she could change it, there were no problems and said her new card should arrive in 2 weeks or less. They only asked for her original documents and marriage certificate.

SSA office in Conroe, Texas...
