F4 is a family reunification category.

So can anyone else start a petition for you?

Nope. Because aunts or uncles can't petition for niece or nephews. And my grandmother either can't for her granddaughter or grandson. Dad has no relatives in us. He is alone.

@Aaron yes what you say it's true. But get a work visa it's really hard. Get a student visa you need a lot of money. A tourist visa also needs money. Why do you think a lot of people want to go to us? When a person can have the chance to move to us with a regular permission and without spending that much...well we are going outside topic. Nothing can be done.

If your uncles and aunts are the siblings of your parents then that's your only option.

But Italy is a nice place to live.

I know we can't do that. but I say it again it's a totally paradox. Ask for residence, when we did a petition for having a residence. Sorry I keep repeating the same stuff. It's the situation that makes me really upset.

You're lucky siblings can even petition in the US. In most other western countries, only parents, children and spouses can be petitioned. The US is VERY generous when it comes to family immigration.

I truly don't understand why so many people want to move to America, why so many people are frantically trying to find a way to get to America?! The real America is nothing like the Hollywood blockbusters. If it's a better quality of life people are looking for then there are far better countries to live in.

Italy doesn't allow to a person grow. Especially for young people who really struggle to work. A lot of italian young people move from Italy and go abroad to seek luck.

You have the whole EU to move to.

You said there was a paradox to require a derivative beneficiary to be residing in the US when the main beneficiary dies in order to get relief.

I pointed out that many non-immigrant visas allows a person to reside in the US. This is a direct answer to your question that you asked about it being a paradox.

Your point that a work visa is really hard to get and getting a student visa requires a lot of money does not matter.

I think a lot of people want to go to the US to have a better life. Billions of people want this. It doesn't mean that it will happen for most of them.

I can only give my story from 1994 (not sure if things changed). My grandma was primary beneficiary, her brother filed for her and all of us. She died in 1992. We came for interview at Moscow embassy February 1994 and we told the staff that primary beneficiary died. They were ok with that and we moved to us September 1994

Immigration laws have not changed since 1994.

The US Embassy make a mistake or there is information missing in your story.

There is NO WAY for a grandchild to be a derivative beneficiary. Derivative beneficiaries can only be a spouse or unmarried child under CSPA age 21. You as a grandchild would NEVER be a derivative beneficiary.

@aaron. you got what i was meaning to say. everyone longs for a better life.

Maybe the kid wasn't born yet when his parent were able to move to us in 1994. But wait, they were able to move to US they were living in Russia when the principal beneficiary died.

You got luck.

Have you considered going back to India if you're not happy in Italy? You're lucky that you have more than one place to choose from. Many people have no option to ever leave their country.
