US bf divorce 3x but we only have 2 of his latest decree

Sounds like he is either being lazy, not properly informed of available records or Florida did not have "no fault" divorces at that time and there is a reason checked off or information he does want to be known. Let him read this forum and he can see the answers for himself.

I just went thru this... FORTUNATELY I live in the same county where my divorce occured 20 years ago.

One of two things - they are on MICROFICHE and you will have to go there or hire someone to retrieve them.

If you retrieve them yourself - Because it was so long ago, you need to be advised that it will not be in computer (online) format. It will be deep in off-site storage. You call the family court clerk and provide them the case number. If you dont have that - they may be able to search by name and other info. You MUST do this in the county that the divorce was filed in. They will take anywhere from 7-14 days to retrieve these records from storage.

If they are like the county I live in - once they obtain from storage, they will automatically scan them so they are now online and then return them to storage so they never have to be fetched again.

Once they obtain them - they will call you. You then go down and get the records.

When requesting Criminal/Divorce records - You tell them you need the final divorce decree for the purposes of immigration. They know what you need and will prepare the papers for you.

Shouldn't he have sent in all divorce degree's when he did the I-129F to show that all prior marriages have ended legally? I'm assuming if it doesn't have it to send you to interview, then he didn't send it with the I-129F packet?

Not that it should affect you, but if he did send 2 divorce decrees and now you show up with a third, they may be curious as to why it wasn't originally included as they have an original copy of all of that, that was originally sent. Also not saying to lie and pretend it doesn't exist, they could easily see it on a background check, but be aware of the full process and what missing documents could end up entailing.

They are not destroyed. They actually work hard to conserve them and the paper used is one that is hard to destroy other then fire...

Someone is hiding something.

However due to his first wife passing on he is technically free to marry.

He needs to be free to marry.

In this situation the wife died after the divorce, but like I had put above, if he's realizing he needs all this now, it's probable that he didn't include a divorce decree or death certificate (unsure if he can get that after he divorced her) with the I-129F, which may end up causing more confusion. Technically by him not submitting it with the I-129F, even tho approved, the application was incomplete because he did not include all prior marriages.

Again though, I'm only assuming he didn't send these things because it's coming as a surprise that it's needed now, when it was also needed at the start of this process (I129F wants all previous marriage divorce degree's to show free to marry, and all death certs if marriages ended due to the spouses death) and he just most likely didn't do it.

In case the CO has issues with the 3. divorce decree not being submitted with the petition initially I would also bring the

death certificate of the ex.

As I said, your embassy has returned petitions because more than one divorce decree was not initially submitted

and they did not accept it at the interview without it going through USCIS first.

Like I said, :

Depending on the State where the divorce occurred, he should try contacting the State Division of Vital Statistics /Health Dept. and attempt to obtain a certified copy of the divorce decree.
