I've been doing some reading and saw that they apparently treat people who are considered self-employed differently than regularly employed individuals, including looking at different amounts on the tax return. My husband has to list himself as self-employed because he technically is, and had to create a business account because of it, but he also isn't really. He signs a contract with a national sports league every year. He's signed the same contract for the past 4 years and will continue to do so until he decides it's not what he wants to do anymore. We only sent the contract for the 2016-2017 season, which I'm realizing was a mistake on my part because it makes it seem like it's a new job. I'll send copies of all of his contracts with the response to the RFIE and include in a letter that it's essentially a permanent position but that they consider their correspondents "freelancers" because they're paid per game/written piece instead of a yearly salary. It's a difficult thing to explain for this purpose, I guess, but he's a "self-employed freelancer" with what's basically a permanent position because it's one of the highest profile teams in the league.

Assets must total at least 3xs the amount...

-send his contract again! With the yearly income and all the requirements of the employment letter. Make sure the contracts he has includes a salary or pay. 

-re do the i864 and make sure everything is correct.

-include bank savings or any evidence of assets. Appraisal or bank statements. Have them stamped by the bank. Point things out to them. I've been told they don't really look for small details and if anything looks confusing they issue RFEs. 

-I also included a copy of the poverty line form 864p I believe and highlight the household size and income limit. Like I said, make it obvious. 

For the EAD your wait may or may not restart. I've seen plenty of people getting RFE and having the EAD approved a short time after, some not so soon. It depends. Wish I could give you a uniform answer. Other members please correct any of this statements if I said something wrong 

I think this is complicating it. They don't need assets. They are far from needing it. I think they just need to correct the i-864 to have the correct numbers on 19a-c (That is the AGI for those years).

We don't have assets beyond a bit in a savings account. We figured that wouldn't really matter because the pay stubs we submitted were in line with what we put for current income.

 

We really don't have anyone who could sign as a joint sponsor so I feel kind of sick with dread right now. He makes way more than enough but I don't know what to do if they won't consider it because he's technically self employed.

So instead of putting the gross amounts for 19a-c we should put the amounts that were on line 22 and then just load up on proof for the current income?

:yes: :thumbs: Yes! If he is technically self-employed look into how other self-employed ppl have shown their income. I know some ppl have written some kind of schedule of income and used bank-slips etc to corroborate it. I don't know the nature of your husband's employment exactly, but YES!

Maybe maybe not. I submitted mine and its been over 90+ days and i didnt get any RFIE or RFE. This is the second ead i applied for the first one i got in 64 days kinda spoiled me lol.

3xs the amount you are short. So if you are shot $200 you need at least $600 in a bank account.

No, I mean that they have written a "summary letter" of some sort, some have made excel sheets... I wasn't talking about the tax. schedules but those should naturally be included :)

Thank you! I'm thinking of including some of the invoices he submits every month because it shows a breakdown of what an average month looks like. His contract doesn't give a yearly salary, but it does show how much an employee is paid per written piece for games/features/injury updates, etc. Hopefully that will help give them some kind of annual average.

 

His job is actually really cool, but in this case...not so much, haha. I'm in full-on panic mode because if we can't prove all of this to their satisfaction we're totally out of options.

Sounds like a good plan. Include anything also that can help clarify it for them (such as a summary letter of sorts) and evidence from different "official" sources are good to help prove that the pieces of the puzzle add up and that nothing is "made up" or "tampered" with. You got this!

 

You are right, it does sound cool :ph34r:.... but it's a sour grape right now I get it..
