Paying the green card fee and name change

Has anybody here have any experience in changing their spouses name when paying the 165 green card fee? Can it be done then? Do they ask you to up date info? We married in China and wife is going to use my last name here in the States..I heard so many ways of doing this wanted to here from someone who has actually done a name change. My wife has not gone through POE yet she does have here Visa approved. we have not paid the 165 green card fee yet.

03/09/2016: I-130 Sent
03/11/2016: USPS Delivery Confirmation
03/15/2016: NOA1 text/E-mail
03/17/2016: NOA1 I-797 by reg. mail ( PD date 03/11/2016 )
06/17/2016: NOA2 Received text and email

06/28/2016: NVC received

07/11/2016:Submit DS-261

07/12/2016: Received DS-261 / AOS Bill

07/13/2016: Receive IV bill and paid IV bill

07/14/2016: Sent package IV package

07/15/2016: DS-260 released and completed

07/15/2016: Scan date

08/16/2016: Case Complete

08/18/2016: Received interview letter today interview scheduled for /09/28/2016

09/28/2016: Interviewed and approved !

10/01/2018: Filed I-751to remove conditions

10/09/2018: Received Text saying case received  ( Nebraska )

10/10/2018 Check cashed

11/19/2018: Received the 18 month extension letter in mail 

07/02/2019: Biometric Appointment.

09/09/2019: Received notice new card is being produced

09/16/2016: Received 10 year Green Card

Which name is on her passport and visa? That is the name that will be printed on the GC.

If it isn't difficult, it isn't worth it.

9/4/16: Wedding!

9/14/16: Received 3xNOAs by text/e-mail (day 2)

9/14-18/16: Received 3xpaper NOAs 

9/23/16: Received biometrics appointment letter (day 11)

10/3/16: Biometrics appointment (day 19)

11/4/16: EAD+AP approved (day 53)

11/16/16: EAD status changed to card shipped (day 65)

11/17/16: EAD/AP combo card received (day 66)

12/30/16: Notice of interview scheduled (day 109)

2/1/17: AOS interview (day 142) - APPROVED

2/8/17: GC received (day 150)

Which name is on her passport and visa? That is the name that will be printed on the GC.

Her maiden name are on passport and visa. I have asked this question before and received about 10 different replies. I'm really looking for someone with first hand info on what they did and what worked for them prior to or at POE...I know what we can do once she is here in US

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

It's too late now. I had to change my name before the interview. I had to change the name in my passport in order to have that name on my green card. You'll have to wait until you are in the US at this point to change her name. She cannot change it when paying the 165 fee.

Cateogory: CR1

  • NOA1/Notice of receipt: Sept. 15, 2015
  • NOA2/I130 Approved: February 8, 2016 (NO RFE) :)
  • Process slowed down by us
  • Sent documents to NVC: April 11, 2016
  • Scan date: April 14/ May 7th (NVC said both I dont know why)
  • Case Complete: May 31, 2016 (No checklist) :dancing:

August 17, 2016: Visa Approved!!!! :dancing:

No you cannot change it then. Green card comes in visa name. If you want to change it you can pay $450 and file an I-90.
