I have been living in the us for almost two years now on a permanent VISA. My VISA is set to expire next year but I have also been informed that I can apply for citizenship next year. What step do my wife and I need to take in order to move toward citizenship?

Who informed you that? They are WRONG.

If you came on a K1 visa it expired the day you came. Just so you know a VISA is for ENTERING the US. Not living in the US.

You should have a Green Card which is Legal Permanent Resident status (LPR). That is probably what you meant when you were referring to your "VISA". The 2 year green card is a conditional one. After to years you have to go through removal of those conditions or ROC (please research this in the Gudies section on this site). You start filing 90 days before your 2 year green card expires. Once you are done with removal of conditions you will get 10 year green card.

After you receive your 10 year green card and after a total of 3 years being married to a US citizen THEN you file for citizenship. If you are divorcing your US you will have to wait 5 years.

Please don't rely on hearsay and use this site to learn the process.

It's all spelled out in the guides. I am assuming you have a green card and want to apply for citizenship when you've met the 3 year requirement as a green card holder.

If you haven't even filed for AOS yet then you have a loooong way to go until you can apply for citizenship.

K-1: 12-22-2015 - 09-07-2016

AP: 12-20-2016 - 04-07-2017

EAD: 01-18-2017 - 05-30-2017

AOS: 12-20-2016 - 07-26-2017

ROC: 04-22-2019 - 04-22-2020

Do you mean you are a PERMANENT resident? I don't think there is such a thing as a permanent visa, and if there were, having an expiration date would mean it is not in fact permanent.

You have a 2 year green card most likely. Worry about Removal of conditions first (making your 2 year Green Card a 10 year Green Card) THEN move onto trying to get citizenship.

Again like others said, there is no permanent visa. You either have a green card, or you came in on a K-1 and never got your green card, the latter is a lot of bad news for you, but I'm thinking you have your green card.

OP, you have no timeline; please construct it.

Your membership on the site since March 2013 would have afforded you much opportunity to study the process.

Let us know exactly what you have (we suspect the 2-year green card), and we can move your thread appropriately.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
