Hi,

My fiancé is in Northern Ireland. He will be dealing with the London consulate now that our petition has been approved. As of 10 days ago.

We are so confused about this affidavit of support.

Let me get this straight... I-134 is for applying for K-1 Visa. I-864 is for adjustment of status when foreign fiancé has already made it to America and we've married?

Question about income.

I've made a bit over $38,000 for 2015 and with my new raise effective this month, it will be a bit over $40,000. I also have a 4 year old daughter as a dependent. Is this enough? Sure, I can do the math but not really. My head is absolutely spinning lol. Everyone has their stress with their situation, yes. I need some solid reassurance if I need a co sponsor or not.

Question about filing.

WHERE DO I FILE THIS THING?!?

There are no instructions on my NOA2 letter. No instructions on the London embassy site. Does it count if I send it and copies of my evidence to my fiancé so he turns it in with the K-1 application?? Do I submit it online??? WAHHHHHHHHHHHHHH lol :cry:

Correct it's the I-134 for the K-1 interview. You send this one to your fiancé with all the supporting document and he will take it with him to his interview.

Yes you income is enough for a family of 3 (Yourself, your daughter and your fiancé).

Yes you are correct on your information regarding the I-134 and the I-186.

Your income even at $38k is more than sufficient to cover the 125% line even for a household of three. (You, your fiance, and your daughter).

And yes, fill out and print the I-134 and sign it and mail it to your fiance along with your tax returns, pay stubs, employer letter and all other required financial documentation required from the London embassy.

Note also that these copies should be signed/dated as close to the interview as possible so that they are "up to date". Typically within 30 days is prefered.

06/30/2016 : I-129F Packet Sent

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

Thank you for the replies!! All the sudden I am not feeling as much like a frantic stress lunatic.

So I send this all to him in a nice, neat, almost OCD way(how I am) and then he presents it to the consulate officer at his interview and that's it taken care of?

I need to stop reading 20 million different things all over the interwebz. It's really messing with my brains. Some site says it needs to be submitted by me so that the consulate officer reviews it before he comes to the interview. ffs LOL

Does I-134 need to be notarized? I'm notarizing my letter stating I still want to proceed and letters from my brother and sister stating our relationship is true...

No it does nor have to be notarized and no letter from your family either. Really you have a very easy embassy!

If it will help, I had my interview at the London embassy on September 30th (and was approved). You really, really, don't need to make any effort to present your financial information. The guy who took my documentation asked for our I-134 form, which I handed over. He then asked for a payslip or letter from my fiancé's employer; I asked if his most recent tax return would be acceptable and handed that over. The tax return wasn't even signed by my fiancé and I had had to manually correct the assets he'd typed in due to a typo. This was all absolutely fine and I have my visa in hand exactly one week after the interview.

Honestly, a signed I-134 and letter from your employer/tax return/payslip is all that the London embassy is looking for. They're so chill.

London is straightforward and make it as simple as possible, all they want from you s the I134 and pay stubs and/or a letter from your employer to verify your income and a quick note signed by you to say you are planning on marrying your fiancé - nothing needs to be notarized and if it's anything like my interview the CO won't look at any additional relationship evidence you send :)

I do make more than enough yearly in wages for a family of 3 including him and my daughter, but for this affidavit, I will only have just a bit over $1,000 in the bank. Is that an issue? Or are they more concerned with what I make? He will be coming over with his own money saved as well.

I do not have a house to account for or really anything else. I live in an apartment and do have life insurance....

No, there's no need to tell them how much you have in your bank account. Evidence of your annual salary is fine by itself.

ok, another question :)

On I-134, question 11. yes or no to intending to make specific contributions to the support of said person and how much?

I dont really intend on giving any kind of exact amount or anything... He is coming over with money and of course I will be paying my bills and rent as usual... the only thing would be food for us... I am confused on what I should put here??

I'm pretty sure you can write in that you're applying for a K-1 Visa/Permanent Residence and you're good to go.

USCIS uses these forms for tons of different immigration purposes so questions like this are more for temporary visits. You could probably check yes if you wanted, since you'll be making contributions to their stay (like supporting your S/O in general) but I think just writing in the above would be fine :lol:
