I-864 - How to proof income will continue of the intended immigrant

Hello - I am applying for an adjustment of status I-485 as my wife is US Citizen, My wife does not earn and is dependent on me. This is my first year working in the US and I have not filed a tax return before, however my income is more than the minimum required income. Questions are:

- what evidence i need to provide in I864 to proof that my income will continue from the current source after obtaining lawful permanent resident status.

- Does my wife need to file an affidavit supporting she is dependent on me?

This is a less usual situation. Can you confirm that you are working legally in the US right now?

Since you and your wife does not have any joint tax returns yet, I'm thinking you might need to look for a second sponsor.

Sponsor for Affidavit of Support

You must be at least 18 years old and a U.S. citizen or a permanent resident. You must have a domicile in the United States or a territory or possession of the United States. Usually, this requirement means you must actually live in the United States, or a territory or possession, in order to be a sponsor. If you live abroad, you may still be eligible to be a sponsor if you can show that your residence abroad is temporary, and that you still have your domicile in the United States.

Section 213A of the INA permits both a "joint sponsor" and a "substitute sponsor" in certain cases.

You need to include a letter from your employer stating such.

Your wife will need to fill out the affidavit with her tax returns and she can add your income if you are working legally and can show with a letter that your income will continue (You will also need proof of current employment, like 6 months of paystubs). Good luck.
