If the U.S. Citizen spouse wrote the $590 check for the permanent resident's ROC, shouldn't USCIS consider that as proof of financial comingling?

Timeline

My package was received on Friday, and the money left my account yesterday. Hopefully my NOA1 arrives soon!

When i did my biometrics for my initial AOS application, I was able to attempt a walkin to get my Biometrics done early. Is that an option with ROC? I'm hoping that it's an option if the appointment they give me doesn't easily fit with my work schedule.

I am planning to go early to a ASC in California once I get my biometrics letter, even though they will assign a Florida ASC because FL is my permanent address. Im in CA for a couple of months for work and then I go to Asia for another few months for work as well. Ill explain this when I try to do a early walk in in a different state. Hopefully it will work, Ill report back when it happens.

May be.it can be an added data point for them about joint mingling of finances. i wrote the check which showed both of our names since its a joint account.

My spouse is currently employed by the U.S. Government and he is working in the United States. I will still check "yes" box for this question, correct?

Yes this is very important. even if you send one day early than your earliest filing date ,your package will be returned.check your earliest filing date using uscis filing date calculator.

I'm sorry if I came across as trying to exclude you from the thread. That's not my intention at all. I was just curious that you posted in Sep 2016 ROC thread if the earliest you can file would be Oct 2016. Otherwise, carry on.

Based on your POE date, isn't October 24, 2016 the earliest date you could file for ROC? So you wouldn't be among September 2016 filers?

Yes this is very important. even if you send one day early than your earliest filing date ,your package will be returned.check your earliest filing date using uscis filing date calculator.

Yes, I agree with both of you. However, the letter I received from USCIS states that "Our records indicate that you entered the United States as a conditional permanent resident on 12/17/2014. You must file Form I 751 within 90 days prior to the second anniversary of the date you were granted CPR status.

I think granted CPR status is the key word because I did receive my CR1 visa on 12/17/2014.

Perhaps USCIS made an error and wrote to you that your conditional green card status is coincident with the date your visa is granted. I don't think it is.

If I were you, I would go by the expiration date on the green card then count 90 days backwards. That would be the date when you can file for ROC. So around October 24, 2016 and not sometime in September 2016.

No worries. If you had filed earlier than the 90-day window, USCIS would've sent back your application.
