Hope. Everyone can help

My fiancé from Vietnam just went for the interview last week and got denied she was in tears and so do I. We had known and fallin love together the pas 3yrs and I really want her to come to the State so that I can marry her. She's the love of mine life, now iam stuck. The. Green letter said that:

Accordance with Department of state policy,the reviewing officer has forwarded your petition to the US. Citizenship and immigration Service (USCIS)with a recommendation that the uscis revoke it on the following ground: the Pettioner and Beneficiary have fail to establish they have a bona fide relationship .

When Uscis receive the return petition, they will contact the petitioner, who will have an opportunity to rebut consular finding concerning this case . For case status information please contact the uscis office where the petition was filed..

I had research online and it take a least 4 to 5 month for the USCIS to contact me and not sure what gonna happen next. On the green letter say that we have fails to establish a bona fide relationship.what do they mean. I tooked 2 trips to Vietnam and the last trip I stayed in Vietnam for 5 months to be with her. We had all picture tooks together and check payed for the airline ticket , visa and passport to proof it. it my first time be member of visa journey. I really don't known where to start. . .hopeing someone will direct me. Iam inlove with my furture wife and I just want her to be with me. Thanks All.

Your K1 petition will be returned to USCIS and it will expire, at this point it is best to give up on that petition

Try to go over what questions were asked during the interview and the answers, was there any area they focused on or could she have answered anything incorrectly

You said you had 2 visits, one of which was extended- was all of that evidence included in your petition? Did you include evidence of an ongoing relationship

At this point I would suggest getting married and filing for a CR1 visa, make sure to put a ton of relationship evidence in to your petition

Your returned petition will not be reviewed but will be purposely allowed to expire because K1's are no longer reviewed, only

spousal visas get that second consideration review.

Do not wait for anything but marry and file a CR1, the K1 is DOA.

Front load your next petition with lots of quality evidence of your visits and communication when you were apart.

I am sorry but the letter you received saying it will be reviewed is not correct and an antique template.

In 6 months + you will receive a letter saying the petition is expired and you can file again.

I would make a complaint through my senator that the CO gave you (and thousands of others) such outdated information.

They need to get with the program and change the letters they give out, it causes nothing but major confusion.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Hi sorry to hear that. Best if you share with us the questions during the interview and from there, members can help you drill down to the reason of denial. I remember one member having the same problem as yours and members were able to derive tjat it was because of religion differences.

So sorry you have to face that. As said above, it's better to get married, then file for spousal visa. Keep faith, it's not because it's difficult that can't make it. Other couples faced worst. Courage.

Did they ask your fiancee in vietnamese or english? because as far as I know, they wants to know how you guys communicate and have she apply for visa before? those are red flags in Vietnam CO looking for.

First , Sorry about your case...But in Vietnam, does not matter how many visit you had, how many photos you had, or receipts you had..if she cannot understand interview in English, the case will not legit. second, she must have clean record, no apply visa before nor sponsor by someone before.

It sounds like, you been there 2 times? with all pics and receipts? There are lots off american people go through K1 visa in vietnam..they most had problem because their partner unable to understand english. Different language is a BIG RED FLAG in Vietnam..
