Hello everyone good day. I just want to ask if does anyone here has any experienced or maybe who knows someone that is the same of my case but different reasons. Please I need some answers here and please respect. I am a K1 Visa I am a Filipina and I was approved last June 16th and went to USA last July 6th but then I decided to go back here in the Philippines my country last August 9th. I returned here in my country because I was having doubts and was not sure and I let the fear of losing my virginity and scare me that is why I go back here. But after I returned here I realized that I do really love him so much and I let my fears take over causing me to leave. I will do whatever it takes to return and to give him the wife that he deserves. I hope there is anyway that I can return in the United States of America to be with my love of my life that we dont have to start the process from the beggining please help me any idea advices or what. All I know is that K1 is a one way visa and you will need to file AOS/AP before leaving US otherwise you will have issues entering again. Did you guys get married? or not yet?

I think you both will need to start again with the process.

No we did not get married yet. Yes we know that I need new visa again but is there any chances that we dont need to start from the beggining again?

Have your fiancé contact the embassy in Manila to request re issuance of your visa, they may do it if you're still within the 90 days of your i94, but it's a slim chance.

Better to prepare and re do all the process, though.

To echo the above poster, K1 is a one time use visa. You are not able to enter again using the same K1 visa. Unless you did apply for advanced parole that allows you to leave and renter the US before obtaining AOS, your only option is to file K1 again, or marry in the Phillipines and file for a spousal visa.

Hi,

Unfortunately you will have to start over again.

Here is my humble opinion. I really think you should marry and file for a spousal visa instead of another fiance vise. Let me explain the reasons why.

  • You had a previous K1 that did not end in marriage so an attempt for a new one may cause some type of extra review which could delay the case.
  • Not only are you getting married but you are losing your virginity. This will be a big event in your life and obviously you are stressed over it. Another K1 will only give you another 90 days. You don't need the stress of a deadline over your head while worrying about marriage and your wedding night.

My advice is to have your fiance travel to your country and marry there. There you will have your support of your family to comfort you. Maybe even have a comforting talk with your mother the night before your wedding for example. You being in a foreign country without family and to experience a life changing event was too much for.

It is ultimately your decision which route you want to take but it is something to think about.

Ask for re issue of under 90 days but its not guaranteed if not re apply
