hi, who among you had the same situation as me, i had my interview today at Manila, the consul ask me if i am aware of any offenses my fiancee had i said yes, but explain furture that it was dropped by the state, our case in under administrative processing, 221g, do you think they will still approved my visa, we did not declared it in the packet because he was not convicted.

How do you know that you are getting a 221 (g)? If you are getting one let's wait till you have it to see what requirements their asking for. All we are doing is guessing.

A very tricky situation cuz something popped up when nvc ran a background check that's how the embassy asked you about it keep your fingers crossed

You might spend time educating yourself on IMBRA http://www.visajourney.com/forums/forum/126-imbra-special-topics/

Maybe you will see something that resembles your case. Also, you need to know what the circumstances were from him. Remember you are going to marry this guy and you want to know as much about him as you can. Your life depends on it. Sorry don't want to scare you but I do recommend knowing what you are getting yourself into.

interesting, I thought you only declare it when you are convicted of crimes that were listed in i-129f.

My fiance was also arrested for domestic violence and spent a night in jail, but he wasn't convicted. His ex wife was addicted to pain meds and was high and wanted to borrow his car, he got really frustrated and not wanting to hit a woman, he instead kicked and broke their table and left the house with the car, hours later when he came back police were waiting for him, she somehow got some scratches on her hand and with the broken table in the kitchen landed him in jail for the night. I believe and trust him though, the ex wife was in and out of jail, hes been the greatest father to his kids and he have sole custody of them. But I agree with greenbaum too, being in a long distance relationship, we can only learn so much about our beloved, it's much better to see the actual police reports.

Can you please update us about your 221g. I guess we better try to get a copy of the police report if their is any.

Hi everyone. From what I've learned that if you have a court case and your a first time offender they put you into an ARD PROGRAM and after a while they remove from the system but since your dealing with the government guess what it's still available for review on their end

smileslovesninj, same situation also, he did not his wife, the ex wife made a story but they found out that shes lying about it and my fiance had evidence that he was not there with the alleged incident happen. we did not put it in the packet coz theres no conviction, he is a good and responsible father and he has the sole custody to his daugther.

The problem is that it was recorded and the background check exposed it to the CO. The fact that you knew about it is a good thing as CO'S want to be sure you know about it BUT since you and he are aware of it and didn't put on your 129f maybe problematic. Wait for the 221g for the answer. It usually comes in an email. Be sure to check your spam folder as It's been known to end up there.

that's the reason we didn't put anything too, cause it says conviction... And we he avoided the hassle of trying to get police reports... I hope you hear from them soon. Did you tell the Consul why your fiance didn't included it on the packet since he wasn't convicted???
