Adult Derivative Citizenship

Hello everyone newbie here. I am ed 31 years old from the Philippines my mom is filipina and my dad is american. I want to apply for Adult Derivative Citizenship. anyone here have tried this? my dad never registered me to the us embassy when I was young but he did signed my birth certificate and supported my studies when i was young but we lost touch and found each other again about 8 years ago and now he wants me to claim my us citizenship so i can go to the US. hope anyone here can share some insight about this matter thank you in advance.

In order to acquire US citizenship when born abroad out of wedlock to a US father, there are certain things that must have been done before you turned 18:

• You were legitimated under the law of the country of your residence, your father acknowledged your paternity under oath, or a competent court ruled on your paternity, and
• Your father agreed in writing under oath to support you until you turned 18.

The second one is the most problematic because it is usually not satisfied unless your father applied for a CRBA for you. Even if your father supported you, or a court said that he had so support you, that is not enough. He had to have voluntarily agreed to this in writing and under oath, before you turned 18. If he didn't, you're not a US citizen.

Yes unfortunately this is true. I have a friend of an in-law in Medellin Colombia, in exactly the same predicament as you, whose USC bio father drug his feet too long and not following through with this procedure and now she is 19 and out of luck.

Your father could petition for you to get an immigrant visa in F1 family preference category. Unfortunately the waiting times for PD to become current are 10+ years and you'd have to remain unmarried.

Yes. Again, acknowledging paternity is the easier of the two requirements, because it can also be a court that determines it, which often happens. But the requirement for written agreement of financial support has no substitute.

Maybe he was born in wedlock. Or maybe he immigrated to become a permanent resident in the US (perhaps petitioned by the father), and did not get US citizenship through birth.

No they were abandoned mom and dad never married he only met his dad when he was 38 and they applied for adult drrivative claim to us citizenship. It took them 8 months.
