Well I've done everything I possibly can to get all the evidence requested (and more) for my NOID. I'm finally driving up to Kalamazoo to see my attorney and give her all the paperwork. She'll be sending it off tomorrow. Fingers crossed...... now more waiting.

My attorney wasn't exactly sure-maybe up to 60 days. I guess I'll have to see what the receipt notice says. Even if it is approved (she's now giving me an 85 % chance ) I can't AOS until November in front of the IJ. That will be over 3 years since I've visited home :(

Jeez Shona I feel for you. Does that also mean that you cant get an EAD until Nov?

At least you are now on the home stretch and will soon know what your fate will be.

Hi Shona,

Sorry to hear about your denial. A close male friend of mine who was abused by his American citizen spouse received a similar notice, giving him 60 days to provide additional information to prove that he was a victim of domestic violence. His letter listed a number of items that could be used for evidence and he had to submit one of the items. My friend initially though that he did not have a lot of the items listed but with the help of friends we were able to put our heads together and come up with evidence for most of the items listed.

My friend pondered on whether or not to use a lawyer and decided to use on only if he was rejected to file an appeal ,because he was the one who had to do all the work to collect the outstanding documents. My received an approval notice two weeks ago and had his biometrics, he is now awaiting his interview appointment.

I am not familiar with your situation,but my friend was only married to his wife for about 6 months, his wife had not even filed the papers for him yet. The home they purchased was in her name, they had a joint account that was opened prior to their marriage and he had a police report from the night he and his two adopted nieces moved out of the matrimonial home. I think that you have more evidence than you may think. You just have to find creative ways to provide the evidence.

Hi Broma,

What I understand to believe is if my I360 is approved I can then apply (this will be my third time ) for my EAD. It's just the adjustment I need to do in front of the IJ (and the travel permit) . As I said before I thought the IJ was great and really kind.

Coco, that's wonderful news for your friend-it gives me hope. Unfortunately although I did speak to the police no formal reports were made so I'm stuck there. What's so annoying is that they even remembered speaking to me. My attorney is going to reply about that one.

I did include 3 more witness statements, which she said were good. One included where my ex had thrown something at my son. My son never even told me this but I am using this as evidence. He also had councelling and in his notes stated how he saw my ex abuse me etc. Also I managed to get a statement from a professional source who my son had to see and in this too he states that he was physically attacked by ex. what hurts is that I never even knew that this had happened until the last few weeks. My son said nothing to me. I have pyschiatric notes saying I have depression and anxiety due to the abuse and three more letters from three separate councellors stating everything that happened . One also said I had PTSD I also included the actual statement my ex wrote and signed stating he abused me due to his mental condition. I have also his hospital notes which I subpeoned during the divorce stating that he tried to kill himself -three weeks before I met him online. I have internet harassment and threats by him which fortunately I saved. All of this and more was submitted as further additional evidence.

I personally don't think I could have done this without my attorney's help, but I did do a lot of work myself gathering all of the information. I just needed someone to guide me through it. She has put a wonderful letter together and I'm just hoping it will be approved.

Yes Lisa your absolutely right. They are supposed to use an "any credible evidence standard" and a prepoderance of evidence,not proving beyond a reasonable doubt!!!

This has now being going on since I basically got here in July 2004. If I am finally denied, I will have to think seriously about whether to appeal as this has totally drained me emotionally, financially and in every way I can think of. I'm tired and just want to move on.

I just saw your name on the list of threads - it has been ages since you posted anything and I just presumed everything had worked out fine for you. What a bloomin' nightmare you have been going through - you poor thing!

It sounds like your new attorney is a great asset and I pray that everything works out for you and your son in the end. It isn't right that you have been through so much - it kinda leaves a bad taste in my mouth too when people like you and my son are treated so badly by the "system". He will have to appear before an IJ soon - we are just waiting for the date to appear.

Please keep us updated - I really, really hope this is settled soon and you and your son can stay. It isn't right that you sacrified everything to be here with your husband and it all went so terribly wrong for you, putting you through all this stress. It just upsets me that you did nothing wrong and have had to deal with all this. I remember some of the posts about stuff your MIL was up to - what a b*tch she was!

You will have days when you question whether it is all worth it and all I can say to that is "Yes, it is!" because you are the one that was wronged here, not the other way round, and you can't let your MIL and husband get away with that!

I got your PM and gave your e-mail address to Hugh.

i just remembered that the police responded to a call at Hugh's house and did not write a report. He remembered the officers name and contacted her and she wrote a letter detailing her recollection of the visit to the home. Maybe you can request a similar letter. I really hope things work out for you.

I did receive an e-mail from Hugh. My attorney contacted the policeman I went to see. He did remember me but couldn't recollect the the conversation so was unable to write anything. It was over two years ago now My attorney did mention this in her cover letter though . It's frustrating that he didn't remember anything, but it has taken them so long to adjudicate. I do have some other good evidence though, so I hope this will be enough. It's been so hard going through this again, particularly discovering things that he did to my children, which I never even knew. They never told me but witnesses saw it.

I just found out yesterday that I received a NOID ( Notice of intent to deny) for my vawa petition. After nearly a year an half of waiting this has devastated me.

Just curious, What form is the NOID? I have never seen that on the USCIS page of documents before.

The longer it takes to introduce yourself the less you've actually accomplished
