Timeline

I have just past my driving test, but they wont give me a driving licence. I have sent off for my EAD and greencard, but only at the beginning of Jan and havent received them yet. They are stating that my I-94 record states that I am K1 status until 10 Jan 07, which has since past. They want to see my greencard, which of course I wont get for a while. Are they allowed to do this or is this a mistake on there part. I performed my test Kansas city, Missouri.

Timeline

Without an EAD card or green card you won't get a DL. Sorry! Happened to all of us.

States have different laws, but that's common. Check out Google for DMV Missouri and you will find the requirements.

Have to agree with the above poster. It was the same for my husband. EAD or Green Card. Without either of those, no driver's permit.

I'm no expert, but as we all know, we have to (apparently) become experts..

I check for MO specifically..and they say you are eligible as a K1 holder...but it has to be valid.. :huh:

Says you need that (the K1 visa) and a passport

From their list of demands..er, I mean requirements..

All documents must be valid at the time of application. Applicants will receive a license, nondriver license, or instruction permit with an expiration date equal to the expiration date of the immigration document (not to exceed the term of the license, nondriver license or permit). Applicants whose immigration documents indicate an expiration date, as “Duration of Stay” will be issued a one-year license, nondriver license, or permit.

Your current status is "applicant for adjustment of status". Missouri DMV site states that you are eligible for a driver license. They require:

Immigration documentation indicating status, and

One of the following:

• Employment Authorization Document I-688B or I-766

• Passport

You can use your Notice of Action (you have received it, haven't you?) to prove your status, and you have a passport.

Print the document out (http://www.dor.mo.gov/mvdl/drivers/idrequirements.pdf) and try again. Good luck!

The passport won't indicate that you are legal in the country (I-94 expired). No DMV accepts NOAs, not that I ever heard of. SSO and DMV told me that the NOAs are nice and I can frame them on the wall, without valid I-94, EAD or GC no DL!

Missouri requirements:

Lawful Permanent Resident (Resident Aliens)

One of the following:

• I-551 card (Resident Alien Card)

• Passport stamped “Approved I-551”

• Passport stamped “Processed for I-551”

• Re-entry Permit I-327

• I-94 stamped “Processed for I-551”

Expiration dates do not indicate the expiration of legal permanent resident status.

Applicants for adjustment of status

Immigration documentation indicating status, and

One of the following:

• Employment Authorization Document I-688B or I-766

• Passport

The tricky part is - NC had the same requirements - that documentation indicating my status is an EAD or GC. You can try your luck though!

My husband got his license with his NOAs. :) It is possible, but not likely. His I-94 is expired as well.

The only way to know for sure is to go to the DMV office in person, bring any documentation with you regarding your status in this country, and ASK. That's how we found out that Georgia wouldn't give my husband a DL without his EAD or GC.

My husband wasn't even allowed to get a CA ID without having either his greencard, EAD, or I-94 that was good for another 60 days when applying. You just have to wait for EAD or GC. Good luck.

Don't you have a UK drivers licence?

Why not use that until they're willing to issue a US one?

I contacted Arizona DMV and explained my situation and they confirmed that I can apply with my visa and once that has expired I can extend my licence with a NOA for proof that I've applied for AOS. I have written correspondance from them confirming this. But as said before, every state is different.

Why not use that until they're willing to issue a US one?

Because, if it's like Georgia, it's only as good as the validity of the I-94. My husband, being Canadian, had a perfectly good and valid driver's permit...but was not permitted to drive on it past the I-94 expiry.

Better try scheduling the DV in between getting the SS card and sending out the AOS application, and seeking AP and.....

The whole process K-1 through AOS is just a ride of joy, sometimes I wonder why on earth somebody would want to go through this process.(well if it wasn't for her then I'd never want to move over but that's another story :) )
