Wife was denied visa at interview Nov 2015. USCIS just sent me NOIR/ 30 days to respond with evidence to try and overthrow the revocation.

I am trying to come up with solid evidence such as joint bank and tax statements saying she is my spouse. I know what I have to overcome. I have passport stamps,pictures,flight schedules,flight stubs,baggage tags,money-transfering documents,call logs(screenshots off my phone). I am working on affidavits from friends co workers and family. Anything helps please feel free to leave some advice. please try not to be negative bc im really trying to keep a positive look on things Now to amend my tax file for joint tax I would need her passport , according to my tax people they said I need her passport bc sometime the IRS does not accept certified copies. But he said I could file seperate marriage so that way her name is in there as my spouse.

OP, to increase your chances of a successful rebuttal, you need to address the specific reasons that were stated in the notice. Unless there is something in the notice that suggest affidavits or joint bank statements would overcome what was stated skip those and focus only on the given points in the notice.

You don't have time to amend taxes. Like Ryan said loo at each denial point and issue make a cover sheet for each point and gather your evidence to address that point. You only have 30 days so please move fast. Good luck.

You don't have time to amend taxes. Like Ryan said loo at each denial point and issue make a cover sheet for each point and gather your evidence to address that point. You only have 30 days so please move fast. Good luck.

He may be able to amend taxes on time. He just have to correct his tax returns which takes less then an hour to do and then mail to IRS. Then can use copies of corrected(amended) returns and add with his reply with an explanation of amended taxes such as he did not know he could file jointly with his wife because wife doesn't have a US social security number. By the time of actual interview, he will have a official IRS transcript on hand. I think he can do that in addition to every piece of evidence he has including additional visits to his wife since his two denials.

Anyway this is a very difficult embassy. Probably toughest.They never gives any specific reason why they deny visa. Sometimes people can assume based on what they focus on during interview. But they deny visa all the time everyday for next to no reason at all. It's the way it is there.

Ron, do your best. Do everything humanly possible to get your wife to US. Don'y hold back anything, don't think or save something for later. There is no tomorrow to save. If you really love your wife she will get her visa eventually. Keep fighting. I did and won. Good luck

Reading your review of your K-1 interview, it looks like the problem there was possibly two-fold. If I have read it correctly, you lied when asked when you proposed to her. She told the officer (truthfully) that you proposed the first day you saw her, when you arrived in Cambodia. But you said it was a week after you arrived. Looks like you were trying to give the answer they were hoping to hear, not the truthful answer because you were worried that proposing the day you saw her the first time would be a red flag. It was at this point that the interviewer's approach changed and he denied you. You wondered why he asked this question. It was for exactly that reason. To see if your answers matched.

Also, you had a translator and he asked if you can understand Khmer. If you had a translator I am assuming the interview was in Khmer. Do you speak any? The questions are quite simple and even people with a basic knowledge of the language would be able to answer. Where do you work? When did you met? These are easy questions. Does your wife speak English? They may be wondering how you two can communicate with each other if you don't speak Khmer and she doesn't speak English.

Reading your review of your K-1 interview, it looks like the problem there was possibly two-fold. If I have read it correctly, you lied when asked when you proposed to her. She told the officer (truthfully) that you proposed the first day you saw her, when you arrived in Cambodia. But you said it was a week after you arrived. I don't think he intentionally lied. Obviously he made the trip to get engaged to his long time girlfriend. They are both from same background and culturally they don't just propose. Usually whole family get involved in engagement process. It was a planned visit and they all and his whole family knew the purpose of the visit is to get engaged, In Cambodia, engagement culturally is a big event. Almost same as wedding. US Embassy knows that. OP might not expected this question and didn't know how to answer. Because their engagement was pre planned way before he made the trip. That's why they might have confused how to answer when did he propose and answered differently. Just my thought though but I am very knowledgeable about the culture there.

His family is originally from Cambodia. So I assume he speaks Khmer. So there is no question about their communication to each other.

Just to clarify my wife was denied K-1 visa back in 2011 at this embassy. I answered 99% of the questions. Somehow CO let me stand next to her during interview. It was a perfect interview with overwhelming amount of evidences. Co was joking, laughing even admitted we are loving genuine couple. After the interview for unknown reason(s), he said he cannot approve us this time. This happens everyday at this embassy and keep happening for many years. Just not K-1, CR-1 and IR-1 as well. I know because I fought this embassy for 3/4 years and made many trips and witnessed countless denials and many of them for no reason at all. It's like winning lottery at this embassy. People who never experienced it they don't know it. It's not like other countries. One of the toughest to pass for K-1 and CR-1.
