K2 visa. Bring child to USA

My wife flew back to Phillipines to get her 13 year old son. With the K2 visa. She is divorced/annulled from the father, And the child has his last name. He never supported them. Will she have a problem bringing him, without fathers Consent ? Time is of the essence.

Philippine Law states that the mother has custody over the child in the absence of the bio father. There is no need for DSWD clearance for a minor holding a dependent visa so long as he/she is sponsored by parents or immigrating to USA.

She needs to get permission because if he calls the police she be charged for kidnapping..

Hi, your wife doesnt need a father's consent if her son is in her custody and no support from the biological father. I had the same case with your wife's case. If she needs help, just message me.
