my case returned to uscis

Hello good people. Thank you all for your kind support on keeping us encouraged. I was denied visa on 07/28/15. USCIS received the case back on 03/01/16. Pls I would like know anyone here have an idea as to how long we have to keep waiting. Thank you

Usually around 3-6 months for USCIS to either re-affirm or issue a NOIR.

I was told by USCIS that it takes 180 days to review the case once they recieve it so about 6 months, and you have to take in consideration if they are behind in reviewing cases also.

If I may ask, why did they deny the visa? If I understand correctly, to deny IV and send case back to DHS, they/CO need very strong evidence that relationship is not legit or something that sort of.

I don't know why I was denied. All the co did was gave me 221g and told me she is sending the case back and I ask her why she said I should go and read the 221g. My wife made her congressman and senator inquire from the embassy and they said they want the case tone reviewed again because they think the marriage is a shame. We have everything to prove but she will not listen to me or take any evidence. She said why did my wife came to marry me alone without family accompanying her.and she also said our pictures looks so beautiful that she can say we went picture taking for the petition. Funny she insulted our marriage. The embassy further kept our paper for 8 months, it took the intervention of the IGP to petition them to forward the paper after my wife petition the IGP about our case. Now we are waiting to hear what USCIS will say is the reason theyy sent the case back.

Ebunoluwa. Do you mean 9 to 12 months at USCIS or from the time the case was denied? My wife called the USCIS several times and the said we should give them 180 days. In fact she called yesterday and they told her by 1st week of September we will get a letter from them either by them reaffirming the case or ask us for evidence.pls what should we put together as evidence waiting for them.

A year + for the whole return and review.

What was marked/checked or written in the 221g ? Submit relationship evidence, everything that shows you are a genuine couple

and some affidavits of family (especially petitioner's parents/siblings since CO made the remark why she traveled alone) that they are

in support of the marriage but couldn't attend the wedding because ------------.

USCIS will either send the petitioner a NOID/NOIR request and it will be listed what they want, or they will send the

petition back to the embassy with recommendation to approve and you will then have a 2. interview at which time you

bring all your relevant relationship evidence.

Another visit or being on the premises for the next interview may be helpful and good evidence.

Ebunoluwa thank you very much and God bless you for the insight you gave me. Yes she is preparing to come but she said if they reaffirmed the case then she will just wait and come for the interview.
