Can my USC boyfriend file for K-1 visa if my marriage here in PI havent been annulled?

Thank you! And this may sound stupid :( but the requirement to bring cenomar (which i obviously wont have) or marriage certificate, do i need to bring that along with my divorce decree? It just sounds contradicting to me.

Yes you must have the CENOMAR/CEMAR. You won't have a CENOMAR but you will have a CEMAR. At PSA you request a CENOMAR if married they issue a CEMAR. You will have the divorce decree which will handle the "free to marry issue"

As some have stated, have your fiance get a public record of divorce from where the final degree was approved. Most states are 30 days, but some are 45, after that most are divorces are automatically approved.

If your former husband didn't give you a copy that is not unusual. He is not obligated. If you're fiance is in another state from where the divorce was filed, and he can find out which attorney filed the divorce, most likely he could pay the office clerk for a copy to be mailed to him, then mailed to you.

Remember, there are copies and 'certified' copies of divorces. Get the certified copy.

Hi!

I have a question regarding my friend status. She came here in US with Tourist Visa but met someone during her stay and both wants to get married. Problem is, she's still legally married in Philippines but has been seperate with her husband for 5 years or so now. If they get married her, will she be able to file for a spousal visa? Or will she be asked to go back to Philippines and be asked for a Cenomar from NSO?

she isn't free to marry, she is still married in her country, the marriage won't count until she has dealt with her current marriage

she will be committing bigamy as she is still married and the marriage isn't valid

Married is married... no matter what country of the original marriage. Unless she gets an annulment she can NOT legally marry.

Hello everyone! Its been a while. Anyways, i did get the divorce decree from San Mateo court. Also, as an update, me and my USC boyfriend will soon have a baby. I'm due to give birth next month and my boyfriend is coming too. I'm not sure if having a baby complicate things for us but all I know is that I'm excited to be a mom :)

Congratulations on your divorce and soon the birth of your child.  Your baby won't complicate things just adds more paperwork and costs.  Besure the father's name is on the BC and ALL na m es spelled correctly.

San Mateo, Rizal?  You say you got a divorce decree in the Philippines, are you muslim, and were you muslim when you married?  The 2nd part is necessary for obtaining a divorce in the Philippines.

 

Nope, having a baby will not complicate things for your visa.  Being your USC fiance is the father you will have to complete CRBA and get the child's USC.

Ahhh!   You were in the USA, yes that divorce is just fine.  (I should have read all the old posts as this topic is YOURS... :lol:   )

 

Being you filed for the divorce and not your foreign EX husband the divorce can not be recognized in the Philippines.  BUT it is recognized by the rest of the world... and the embassy of course ;)

When you file for CRBA you will also complete the application for a U.S. passport.   No problem.

 

Do make sure to go to DFA  and apply for the Philippine passport as soon as you get the PSA birth certificate also.

One area im sort of doubtful is the CFO :(
