I have applied for F4 visa for my brother in 2007. His son is currently 19 and will be above 21 when the application gets processes somtime in 2019-2020. What is the procedure for in such a scenarios for my brother's son? Will he be allowed to join my brother and his wife? Do I have to apply separately for him? The USCIS website only says that spouses and children under 21 can join siblings under the same application. It does not mention the procedure for children of siblings above the age of 21.

Your brother will have to apply for his son. (Once your brother has his GC.) It will be F2B category then for your nephew. Your nephew must remain unmarried during the wait. Right now it's 7-8 years wait for a visa number to be available in that category.

When application was approved by USCIS . May be aged out children will get benefit from CSPA rule.

Don't worry Nvc automatically add his name when your priority become current my brother name added automatically. So many people are going to USA with age 28 unmarried.

2019/20 sounds optimistic.

Unlikely CSPA will apply, has the petition been approved, if so when?
