Dear Fellow VJ's

As part of Step 1 for obtaining a GreenCard, I was in the process of filing an I-130 petition for my spouse. I am enclosing the following documents with the cover letter -

1) Personal Check $420 for the fee

2) Copy of my G.C (front+back)

3) Copy of Passport (Self +spouse)

4) Marriage certificate in English

5) 1 Passport size photo each of self and spouse

6) G325 (Self + spouse)'

7) Marriage invitation card

8) 3 pictures with parents and family of the wedding day

9) Form G-1145

Questions -

1) Is the above list of documents sufficient for this purpose?

2) I see the instructions for I-130 say that "one or more of the following may also serve as evidence". These include - Joint ownership of property, joint lease, Comingling of financial resources, Affidavits from persons and other relevant documents. My question here is that I do not have any of these, does anyone see this as a potential problem if all primary documents are in order?

3) Do the copies of original documents being sent with I-130 need to be notarized/certified?

well... I wish I had enough experience, but here's what I have:

when I first applied I put a lot of evidence (lease of joint tenancy, copies of our back accounts, receipts for the gifts and so on)
but this was rejected for no reason and sent back and i never received it. so the second time i filed I just put what they say we MUST attach.
and this encluded:

1. Check

2. G-1145 for I-130

3. Form I-130

4. Copy of naturalization certificate

5. Copy of passport page with name and photo

6. Copy of marriage certificate

7. Copy of final judgement of divorce

8. G-325A of both spouses

9. Copy of account statement

10. Copy of petition for name change

that's it.
now I'm waiting for the responce.
And the copies you send don't have to be certified.

If they need originals, they'll send you a letter asking you to send them originals of the documents they need. But if it's not stated anywhere, you should just send regular copies.

P.S. Just for your sake, scan or copy EVERY SINGLE PAGE of what you're sending, cause in my case the whole package was lost and there was a lot of evidence, but I have it scanned and saved on the computer.

I would also suggest you write it in the cover letter, that you have all the copies. this is how i worded it in mine: "If you need any copies of the documents I submitted (as well as the forms attached) please contact me and I’ll send the copies as soon as I can. All the forms and supporting documents I submit have been scanned and saved on my computer, so there won’t be a problem for me to print them again and send to you".

this is another way to protect your documents from being sent back to you rejected for nothing.

P.P.S. When you send your package put a prepaid envelope in there, just in case they send your documents back to you (which shouldn't be the case but better safe than sorry) you will be sure they reach your address, cause they send the docs back without a tracking number and if they don't get delivered to you they will be just lost and noone will be able to help you with that (i have sad experience with that)

5/6/2016 - delivered and signed up for by R Mercado [Day 1] 7/20/2016 - called to submit a service request for my EAD. [Day 76]
5/12/2016 - checks cashed [Day 7] 7/28/2016 - case numbers for i-130 and i-765 started working to say case was received on May 6 [Day 84]

5/16/2016 - got 3 NOAs in the mail, dated May 12, priority date is 7/29/2016 - case status of I-765 is "New Card Is Being Produced", later in the evening - "Case Was Approved" [Day 85]

May 6 (haven't received any emails or texts) [Day 11] 8/1/2016 - received answer for the service request "your case is under review" [Day 89]

6/10/2016 - got biometrics letter in the mail, notice date is June 4, 2016, which 8/1/2016 - received answer for the service request "your case is under review" [Day 89]

is day 30 from when they picked up the package [Day 36] 8/2/2016 - case status of I-765 is "The Card was Mailed to you" [Day 90]

6/21/2016 - Biometrics walk-in in Philadelphia [Day 47] 8/4/2016 - received I-797 Notice of Action for approved I-765 [Day 92]

6/22/2016 - Scheduled Biometrics Appointment [Day 48] 8/5/2016 - EAD in mail [Day 93]

6/30/2016 - online case status started working "case is ready to be scheduled

for the interview" [Day 56]

8/9/2016 - Interview is Scheduled [Day 97]

9/14/2016 - Interview Day [Day 133]

Even though my husband and I have been together for close to 10 years, we kept certain things separate. To prove that our relationship is bonafide, we sent quite a lot of photos of vacations, date nights, pics on our way to work, wedding pics with our families, church pics with our families, a copy of our credit cards under one account, copy of our daughter's birth certificate, emails since 2007, life insurance policy showing spouse as beneficiary and car insurance showing both of us as the insured drivers.

Originals are not required unless they ask for it. I read it somewhere in the instructions.

Please include Form I 130 in the package. You left it off your list :-).

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
