My question is, My sis is living in Hong Kong with K1 Visa completed DS-160. She has a 20 year old son in Philippines. We are confused for the processing,does he needs to fill up DS-160 right now or he needs to wait a letter from Philippine embassy

This is the same case of one VJers who's mom K1 is in Montreal and he K2 is in Manila.

The K1 in Hong Kong should request US Embassy Hong KOng to endorse the K2 processing to US Embassy Manila. When the case is transferred to Manila, he can file K2 in Manila. The clock is ticking for him if he is 20 now. When is he turning 21? Don't wait for anything from the US Embassy, they should act now.

Thank you guys for the help i really i appreciate it. Hi Cristina16 he is turning 21 in October but the petition will lapse on June 2016. Can the petitioner request to extend the processing?

Don't worry about the NOA 2 validity, that can be extended and some embassy automatically extends that (like Manila).

First is you should request Hong Kong US Embassy to transfer your son's case to Manila. That is asap. Ask your fiance to call or you can also call the embassy how to proceed. The actual transfer may take sometime. Keep in mind, your son should be in the US before he turns 21 to avoid technicalities.So his time is ticking. This the same situation I don't want to be in. My daughter will turn 21 in March 2017.

PH US Embassy cannot do anything unless the case of the son is with them. Or better yet, since it just very easy to go to HKG for Filipinos check with the embassy if he can apply for his K2 in HKG even if he will be just visiting for medical and interview and not a resident. This is a better alternative is possible.

Hi Cristina16 thank you for the help, the request has been forwarded to MAnila US Embassy & My sis will get update very soon. She called 2 times at the Embassy for further instructions. Thank God because people working at the Embassy are very helpful. I think the dependent children can travel to the US on a K-2 visa within a year of the issuance of the K-1 visa to the principal beneficiary.

Don't wait for a letter from the embassy, he will need to complete the DS-160, pay the visa fee at BPI - bringing his passport and print a deposit slip from online to do this (LINK to this in my signature below).

Also contact USEM about the case file transfer, there is contact info in the link in my signature below. USEM can access the digital copy of your case file quickly, which is why I suggest contacting USEM regarding this.

Then you will need to get the appointment scheduled at USEM.

The embassy will automatically extend the petition up to a year, as long as it is an active case file. Your son will use the same case file number as you have.

I am not 100% sure of this, but since he is going to be 21 this coming October, your son should be with you in the US and file for AOS prior to him turning 21. Of course all this after you got married. I believe if he fails to do AOS prior to him turning 21, then he might have some issues that might end up back to the Philippines. If that is the case, then you can petition him again under the immediate family visa program which might take some time.

If I am wrong or have wrong information, I would love to have someone correct me.

if not, then he will need to be petitioned and children over 21 take a very long time,

time has been wasted, so waste no more time in getting things done before he turns 21

Yup 21 years of age can be an issue. There is a work around, of sorts, for it, a couple in Guam are going through this.

As soon as the son have the MNL number he can do medical and schedule interview.

Everyone are right, major consideration is his age. he is turning 21 in October and to be safe, AOS should be filed before he turns 21. There are technicalities here and you don't want to risk his son to sent home and wait for atleast 10 years.

The K2 follow to join for a year is only applicable for K2 visa application itself from the Embassy Manila from K1's date of issuance of Visa. Upon issuance K2 visa is only valid for 6 months from medical date. therefore, the son needs to leave as soon as possible. I hope the case can be forwarded this month in Manila and he can do medical and interview asap.

So consider the following:

1. Mom's Visa issuance date

2. is mom already married, if not when are they planning to get married? or is the mom already in US?

3. AOS of son should be filed before Oct 2016

4. the son should be ready for his medical and interview asap. All docs should be completed and ready.

Not correct - There won't me an MNL# the case file number will be the same one as the K-1 in HK

My Sis instructed by HK US Embassy that they are going to forward the Case to Manila Embassy once the her K1 Visa issued.

The thing is HK US EMbassy is very strict. My sis was annulled & required to get Cenomar from Philippines My nephew send a copy of Cenomar by his request but HK embassy did not acept it.. Does she needs to get Form request from Manila Embassy? I don't see any form in the website. Is there anyone related to my sis case?
