Shes been here for 2 years with a J1 visa for an exchange program. In February her Visa expired and she filed for a B2 tourist visa and they say they are analyzing it and will give her an answer in June. If they deny it she'll have to go back to Brazil. I love this girl and don't want to see her have to leave! We live together, my daughter is comfortable with her, and it'll kill us if she has to leave for however long it takes for her to get back. We don't have the money for her to do a student visa... so my only option in filing for a fiance visa. What is the process for this? Is it too late? I don't want to see her go!

Her old boss in California was supposed to sponsor her for a student visa but is now threatening that if she doesn't come back to California she won't sponsor her... I don't know what to do! Please help!

Yes, don´t think too much... If you really want it... Go for it.

Me and my actual husband (boyfriend by that time), we were "stupid"... I didn´t wanted to be illegally in US, so I came back to Brazil to settle some things (I have 2 kids from another marriage, and I had to take them back and talk with a lawyer and don´t be a kidnapper by Brazil´s law, get some more money and come back to announce our engagement and take a breath before being apart just for a K1... It finished with a removal for me when I went back to US and now it´s been a year that we are apart waiting to be together back again...

No engagement party or celebration and a marriage just with his parents and my kids...

Suffering is just a nickname about what we are passing through... :(

If you really love her and don´t want to be like I´m... Do it...

Applyinh for a fiancée visa means she would have to return home before her current visa expires. Processing would take 6 months or more.

Since she is in the country now and entered legally, your best option is to marry and file to adjust her status concurrently. That way she can stay in the US during processing.

There are fees involved, and you need to show ability to sponsor her financially. A co-sponsor may be used if you don't meet the requirements.

Op, why did you file for a B2? This would, even if approved, only give her another 6 months maximum, and she could not work during that time.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
