I wasn't asking to comment on that story, I was asking about similar experiences here on VJ.

Similar to what?

You worry way too much, and this is coming from a woman who used to worry about everything. :D

yeah... I wasn't as worried about my own immigration as I am about his case. Even the secretary at the embassy told me to calm down when we went to submit I-130:))

I guess you're right, they issued him a visa later and he used it properly. We also have strong evidence. We just need to wait again.

My immigration journey

July 2009 - F1 student PhD program

AOS
June 2010 - married USC

August 2010 - sent I-130 and I-485

December 2010 - CGC received.
December 2010 - ex-husband got crazy
May 2011 - separated
November 2012 - divorced!!

I-751 waiver

October 13 - filed I-751 waiver by myself
November 28 - BIO & InfoPass to submit a divorce decree

December 2012 - CGC expires

May 3 2013 - RFE received, asked for a divorce decree (haha) and address clarification + more evidence

July 6 2013 - RFE mailed and received

September 2013 - InfoPass, passport stamped to extend my status

November 2013 - Finally an interview is scheduled
December 12 2013 - Interview. Approved without any questions, passport stamped. Same officer who did my initial interview (I was told "I saw it coming, don't give up on love" :) )

December 27 2013 - Card received, too bad I was overseas

January 2014 US entry, special screening, but admitted instantly once I got to speak to the officer. It's a standard procedure if no valid GC on hand.

July 2015 - MARRIED in Russia

N-400

October 2015 - N-400 sent

February 2016 - interview and test

March 2015: USC!

DCF for my husband

April 2016: InfoPass to file I-130 in Moscow, approved on the same day.

May 2016: DS-260 interview - AP for "dangerous" work field

July 2016: visa issued! 59 days in AP.

May 2018: filed I-751

June 2018: 18 months extension received

I traveled all over the world in the meantime, no problems with visas and entries, occasionally some explaining and more documents to haul around.

people getting denied a CR-1 visa because they had previous visa denials.

I guess they don't believe all the folks saying there has to be something more to the story, because a denial for a visitor visa doesn't mean a CR-1 will be denied. Unless there was a more serious reason for the denial than inability to prove ties to home.

Immigrant visa denied because previous tourist visas were denied. Or anything related: denied tourist visa, but got immigrant. Denied both visas because previous denials looked suspicious the the officer and how it all ended. etc.

Actually, I asked to hear what you just said: previous denials don't matter unless there is something else. Also it would be nice to know specifically what other reasons there may be and to compare it to our situation and try to guess the outcome, i.e. how likely are we to get in trouble with AP and so on. I don't know how big of a deal are his old denials or that he didn't mention me when he applied for a granted tourist visas, even though we were dating at the time and I'm trying to measure it.

but mostly to hear that it's going to be ok.

Mostly you see approved immigrant petitions, but you do see denials.

Misrepresentation in the past or current visa application. In other words, lying in an attempt to get a visa. Or in the current visa application, such as not disclosing the past denials. They will have records of these. Having entered the USA and leaving before the I-94 expired is a very positive sign. It would not have been granted had they found past misrepresentation.

He always listed these denials on all applications that asked for it. We don't have a case number yet, so he didn't do the DS-260, but of course denials and entries will be there. I am convinced one must truthfully answer all questions to the depths of their understanding, but I prefer not to give extra info to the officer unless I am asked directly. :)

OP: You're worrying for no reason. You need to find a way to calm down.

yeah... the only time I am calm is when I'm training at the gym. And that's only an hour a day.

My husband applied for a tourist visa to the US back in 2012 and was denied(no travel history). Within 2 months he got an invitation to a conference and got denied again for the same reason. We were just dating at the time. We traveled all over the world together and in 2014 he was granted a US tourist visa. He came to visit twice, last time being already after the engagement.

I just read a story that a woman's visa was denied at the consulate after I-130 was approved because she had denials for B1 and F1 student visas before.

I am worried sh*tless.

I try to calm myself down that if my husband wanted to illegally stay in the US, he had a chance and he would have done it last year after the engagement... but he didn't. Instead we spent time and money to meet outside of the US. :bonk:

Does anyone have any input or experience with previous tourist visa denials? We did DCF in Moscow and our I-130 was approved pretty much on the spot (but that woman's one was too!! AAAA!!! :huh2: )

People are worried for no reason. Please calm yourself down and just think about the whole thing, it doesn't even make any sense. Because of denial doesn't mean ban from USA.

My wife's visitor visa was denied last September, we were preliminarily approved for our CR1 on April 13th. They didn't even ask her about that tourist visa denial, I guess the only comment I would have is I hope you noted the denied visa in the I-130 that you submitted. Try to relax and wait it out, these things are not easy, just keep your chin up. :)
