Hi folks,

My wife came here on a k1 visa we married and now waiting for the conditional 2 year green card. She has a child in the Philippines that's 13. I am not the father or related to in anyway, except being married to the mother. My question is can she/we petition the child to come here and how to go about that.

Thanks for any help

Yes he was listed on the I-129

Then you'll need to do a K-2 follow to join. Contact the embassy and they will give you the information. He'll need a medical, ds-160, visa fee and the interview and then he'll be able to come.

It's a bit old but take a look anyway:

Hello, this is a follow up to this issue. My wife got her EAD card with advanced parole and is traveling to the Phillipines to bring her child back. My worry is that her interview for AOS might be scheduled and she may miss it. What could happen if we miss or postpone due to her bring out of country?

Thank

Can she hold off on traveling to get her son until after the AOS or receipt of the GC?
