My fiance and I just got an RFE last month. They are asking for our Intent to Marry letter because he forgot to include in our packet. My concern is, eventhough, my G325-A form was signed by my fiance which is supposedly to be sign by me ( we included it along in our forms) and they didnt even bother to be one as the request for evidence and ask for my signature on it. I was expecting that it will be one of our RFE's but it wasn't. Question: Should my fiance send another G325-A with my signature this time along with our intent to marry letter or should we just send what they are asking from the mail which is only the intent to marry letter. And wait for their instruction what to do next?

Follow up question: Does it need to be an original letter of intent to marry with my signature (to make sure that they we approve it faster) or can I just simply print, sign, scan and send it back to my fiance?

Im hoping to seek help and clarifications on you guys who have the same issues we have. I can't wait to be with him and i dont wanna take risk this time. Having an RFE slows the process. Sad realty :(

The G325a has to be signed in black ink. No photo copies. You should ask your fiance to send one signed and FEDEX OR DHL.

Also letter of intent to marry must be signed and dated with black ink, no copying.

Lets hope they don't RFE you for the signature but if they do, then you should have one by then from you fiance along with letter of intent.

No scanning on both...signature has to be wet.

For now just send them what they are asking for.

I spoke with my lawyer and he said that he has had some cases where they do accept a scanned signature, but that it is always better for it to be original. My fiance is an Afghanistan and was definitely hard to get him to sign it, and receive it back on time. My suggestion is to just try your best. If you have the time and are able, take the time to do it right, because if anything is missing this time, they could deny your case. if you are unable, maybe you could just explain it in a letter as to why it would be difficult to get the signature. I also included my fiance's email address, and phone number. just to give them a little insurance that they can call you if there is any question. Good luck!

If USCIS going to be making calls to everyone with concern to their "RFE" then most of us petitioners will be waiting for years to have approvals. I really doubt that USCIS will be calling anyone at all...This is the reason they have guidelines and procedures on how to fill out the petition and complete it.

Also, maybe your lawyer is right that is some cases they will overlook the signature and let it slide, but that does not mean anyone should be doing this. I doubt that all adjudicators process petition exactly the same way and yes, some might or might not slip through the process if the signatures are copies and not wet.

Its all about taking chances that I did not and will not!! When you are really anxious to get your fiance to the states, then you end up with RFE left and right, it will do nothing but delay your petition. That could turn out to be weeks to months...

Hi @pch1, why does it need to be in black pen? It is really necessary? I read some website that forms should be in signed in blue ink. Im just being curious and wanted to make sure. Thank you.

Read the guides, black ink, if you read the instructions for USCIS forms they say Black ink.

1) Shame on your fiance for signing YOUR G-325A.

2) Only send it what is requested in the RFE letter, nothing more. Follow the instructions in the RFE. Make copies of the RFE and the LOI for your records.

3) The Letter of Intent to marry has to be original with your signature - not a copy. I suggest sending it to you by FedEx, UPS or such, PhilPost really sucks...

Guys, the "Type or print in black ink" instructions refer to the data being filled in the form, not the signatures. It's completely fine to sign using either a blue or black pen, provided you send the original and not a copy.
