I came to this country in 2007 on F1 visa met my ex in college he went to join the army we got married in 2010 and later got divorced in 2012, it was a legit marriage and army played a big role in us falling apart, i filed an application to remove conditions from my gc with my divorce papers photos letter etc and received a permanent 10 year green card in 2013. I will be eligible for applying to US citizenship in few days so you think sending divorce papers is enough and thats it. I am still single and he is married, do I need any papers from him?

Nope.. Looks like you used the 5yr rule so you don't need any paper from him. You just have to answer truthfully any question asked about you, your past marriage, etc.

Good luck!

You'll need your marriage certificate and your divorce certificate.

You should be fine, because you don't need to be married to apply under the 5 year rule. However, you may be asked to demonstrate that you got your green card legitimately. Some applicants (many, but not most) in your situation are asked questions about their marriage. This is to make sure that you were in a legitimate relationship when you got your green card and when you went through ROC. It looks like you got divorced before your got your permanent green card, so you've already explained all this before. Just my opinion, but when it's time for the interview, i would take as much proof as possible of the original relationship. You'll get approved either way, but having everything with you may speed up the process.

I was in the same position as you. I got divorced and had to prove our relationship was legitimate when I went through ROC. I just had my interview and the IO didn't ask anything about my previous marriage. She just went through the N400 form and verified that's his name and birthdate. Mind you, I didn't even send a copy of my divorce certificate and marriage certificate. I asked a lawyer for advice prior to applying due to the divorce. He told me that since I have proven that the marriage was legitimate when I removed the conditions on my GC, it should be little to no questions asked. He was absolutely right in my case. Good luck with everything!

Hello,

I am in a similar situation, I am LPR since 2011, ROC was in March 2014. I am divorced since July 2015. My problem is that I will file under 5 yr rule, I have filed taxes 2014 and 2015 but 2011 to 2013 were suppose to be filed joint, I just found out that he failed to file for those years.

Any advise...?
