Hello. I have a question about the k-1 visa process. My embassy interview is set for March 2nd.

I am currently employed in Ontario, Canada. If my k-1 visa is approved, must I leave my current job right away?

I am looking to be employed in Canada until I can find a job in the US.

My goal is to be with my fiancee, find a job in the US and move then while remaining employed in Canada in the meantime - using the k-1 visa as an avenue so companies don't have to provide sponsorship.

Is this possible? I have contacted different authorities on the matter and nobody has had an answer?

I would get married once approved, and apply for all the remaining statuses to become a permanent resident and obtain a ssn while remaining employed in Canada unless I was able to work in the US.

Any information on the matter would be greatly appreciated.

How will you continue to work in Canada once you arrive in the USA to marry and will not be able to leave without AP or green card?

Is it online work or a work from home type of position?

Once you move to the US, you will apply for AOS along with which you will submit an application for work and travel authorization. This authorization combo card usually arrives in 3 months after submitting the AOS.

Basically, until this combo card arrives, you will neither be able to leave the US nor work in the US.

Your K1 visa is normally valid for 6 months from your medical date. Use that time to save up however much money you'll need, because you wont be able to work until you have filed for adjustment of status and your employment authorization.

Met 2008. Moved in together 2010. Married 2015. Baby Z joined us 2017 . :wub:

AOS Timeline 350 days

 

May 31/15 - Sent AOS/EAD/AP to USCIS

June 4/15 - Email and text notifications they were recieved

June 10/15 - NOA1 for AOS/EAD/AP Dated June 1

June 17/15- Change of address confirmation

June 22/15- Biometrics appointment received

July 1/15- Biometrics appointment done(5 minute appointment, 8 hour round trip drive <_< )

August 5/15 - Change of address submitted for new location

August 8/15 - Mobile/E-mail notifications for approved EAD/AP :)

August 17/15 - Change of address confirmation after calling in

August 17/15 - EAD/AP Combo card mailed out(To the wrong address, and then lost by USPS)

September 3/15 - Contacted USCIS and was told to re-apply with a new application and fees?! Put in a service request online for lost card, and a complaint

September 8/15 - USPS found & returned card to USCIS

September 15/15 - Ombudsman contacted USCIS

September 17/15 - Card mailed back out

September 19/15 - EAD/AP Combo card finally in hand

September 22/15 - NPIW letter received, dated September 9/2015 estimated 6 month wait

October 13-21/15 - Traveled using AP to visit parents & ship the rest of our belongings out west

November 27-30/15 - Traveled using AP

December 28/15- RFE hard copy, waiting on documents from Canada

January 31-February 7/16 - Traveled using AP

February 10/16 - Sent in RFE, delivered Feb 16

April 16/16 - Service request filed, RFE was never updated online

May 12 - Approved email and status update dated May 10. Service request never was assigned or solved, though.

May 14 - Greencard in hand!

I am unable to enter anymore as a visitor?

As I was planning to enter as a visitor (as I've numerous times as me and my fiance are only 3 hours apart) - then get legally married and return to canada to continue to work. Then would apply for AOS, AoEA and obtain a SSN from there?

in order to be able to work in the US at the earliest possible time, bear in mind that you need your marriage certificate before you can apply for the Green Card (and work authorization/advanced parole), so make sure you can get same-day service to get your certificate in hand. Some places can take weeks after the wedding before you get the certificate.

Sounds like you applied for the wrong visa.. You should have applied for a spousal visa if you wanted to be able to work right away.

You cannot marry and then leave the country without applying for AOS and having AP or your green card.

Exactly. You should have come in as a visitor, get married, go back to Canada and then have your spouse apply for K-3. You can still do that but then you will have got the K-1 visa for nothing. Since the K-1 visa is valid for six months, I agree with an earlier post that you should try to save money for a few months and have your fiancé visit you in the meantime.
