CBP Officer KEPT my medical... Don't I need it for AOS?

I turned in the large DO NOT OPEN envelope to the CBP officer in Chicago. He opened it and it had my medical in it (among other things). He didn't return it to me, even though I asked. I thought I needed to include this in my AOS application?

Welcome to the forum.

If you wanted a copy of that report, you should have asked at the physician's office/clinic where you had the visa interview physical performed. The CBP officer correctly retained all of the paperwork, it is to be forwarded on to USCIS.

They were supposed to leave the DS-3025 and a CD with you; did he not do that? You need the DS-3025 for AOS, otherwise you'll need to pay for a new medical again.

They were supposed to leave the DS-3025 and a CD with you; did he not do that? You need the DS-3025 for AOS, otherwise you'll need to pay for a new medical again.

The CBP officer does not give the DS-3025 and CD of xray. The panel physician that did the K-1 medical provides those things to the K-1 applicant.

When you went through PoA, did not the officer returned anything to you? I have seen you came here with K-1 visa as most K-1 visa holders I have read here never get anything from CBP officer. The sealed envelope as the previous poster said have been sent to USCIS office.

For the OP:

The CBP officer did not give me anything after he opened my sealed envelope. I had a copy of my DS-3025 with me that I have included with my AoS. The doctor who did my medical gave me one copy. If your medical is still good within a year then you don't have to redo your medical again. Just send the copy of your DS-3025 and you should be just fine.

Ohhh wait, I think I'm confusing things. The sealed envelope was actually opened during my interview in Montreal, right? It feels like that was so long ago. I forgot. :/

Based on my experience - as vary from many people- I went to the doctor, took my medical exam which was sealed and brought to my interview ( and yes, the lady from US embassy opened it in front of me). After I got approved, a few days later I came back to the US embassy and gave me passport of mine, the sealed envelope which was I believe included my medical result and other docs.

I came to the US and when I went trough my PoA at Detroit, Michigan, I gave the CBP officer the sealed envelope, he checked everything inside, took my fingerprints , picture and that was all.

It's completely normal for the CBP to take your medical, they will send it to USCIS. You should have been given, or asked for, a copy of your medical because you need the vaccination part for AOS.

Try to contact the clinic or the embassy to see if they have a copy of it because you will need to send in the DS-3025 with your AOS application.

Is the DS-3025 copy absolutely necessary? I did not get one handed back to me but im 100% positive I have the vaccinations complete, the doctor showed me at the medical.

Im reading another thread where it says you dont have to send it in if you are 100% sure they are done?

What if I don't have a DS-3025?

"If you are positive that you got the needed shots, then actually mailing in a DS-3025 photocopy is not necessary. The original form is with your other medical results and was turned over to USCIS at POE. That's actually the one that counts because it remained in the "chain of custody" so you didn't have an opportunity to alter it. The photocopy isn't really an official copy and is more for a reminder that you got complete at your visa exam. Of course without having a copy, you don't have the opportunity to see if the rest of the form was completed correctly."

In terms of the quote you provided above, I HOPE THAT THAT IS TRUE.

Now, in my particular case, my doctor abroad REFUSED to fill out the vaccination section, even though I pleaded with him. However, I did go to a panel physician here in the U.S. and had him fill out part 7 of the I-693, but I DO NOT have a copy of my abroad medical. The doctor also REFUSED to give me a copy.

So I'm hoping that USCIS already has my medical from abroad and that I don't have to provide a copy in my AOS application. I will provide part 7 from the I-693, obviously.

This is correct. They will already have your DS-3025 along with your other medical documents. I would include a note stating that you had all the required vaccinations and the DS-3025 vaccinations worksheet should already be in your file along with the rest of your medical documentation,

You are not required to send a copy of your K-1 medical with the I-485. All of your immigration documentation from the I-129F to the K-1 visa interview, including your medical forms, were in the sealed envelope you hand over at your POE. Those are then sent to the USCIS and make up your A file. Unless they somehow got lost, the USCIS already has your medical results.
