CAN I GO WITH MY HUSBAND ON HIS NEXT PCS IF I DONT HAVE GC OR AP YET?

I got here last aug 15 and got married on the 31st.
My husband got his next pcs orders lastweek which will start on the first week of march in Yokosuka,Japan.. and i really dont know if i can come with him or not because i havent processed my AOS yet..
i hope you can help me with this matter.

it's got to go into the USCIS office ! Did you apply for AOS yet? Yes? No?

If no, include a cover letter requesting military expedite, show the PCS orders with your name on them.

If Yes, call into USCIS , use a telephone today, and get an ISO Human, a Tier 2 Human, and tell the Tier 2 Human you want to facilitate a Military Expedite, asking for the fax # to send the docs to.

There's a bit more to it, than this, but hey !

no i havent applied yet. how many months will this take? he supposed to leave lastweek of febryary

AoS can take upwards of 4 months to process. But my concern is your timeline in your post. You arrived August 15th, married the 31st, It is now 01/06. There is a 90 day window for you to marry and file papers, that starts upon arrival. That means you should have filed around November 15th, You are 2 months past due on your filing. Unless you were an IR1/CR1 applicant.

So basically, first thing i have to do is file AOS and what will make it different from the others is that i will put a cover letter requesting them to expedite it? I thought there is another way if he need to go to the pcs soon.

You will file as normal, but you will also make a request to expedite. Here is the USCIS page about Expedited requests. http://www.uscis.gov/policymanual/HTML/PolicyManual-Volume1-PartA-Chapter12.html

A. Expedite Criteria​ [1]​
USCIS may expedite a​ petition or application if it meets one or more of the following criteria:​

•Severe financial loss to company or ​person​;​

•Humanitarian reasons;​ [3] 
​
•Nonprofit organization whose request is in furtherance of the cultural and social interests of the United States​;​ [4] 
​

•Compelling interest of USCIS.​
C. Making an Expedite Request ​​

Wouldn't you have to wait for your child to enter the US and get his green card before you join your husband in Japan? Or are you planning on flying your child over and include him in the expedite?

Yes,that is what im thinking of.Get him here and then file for AOS together with my son and go to Japan..and since i cant get him without my AOS,i have no choice.I decided to stay here until i can file for aos and just get my son.And my husband will be going on his next pcs station next month.
