Administrative Review - Who else, how long

I am just curious how many others find themselves in that big black hole called Administrative Review, how long you have been sitting there and what courses of action you have been taking?

Mine has been there for 6 weeks. I am giving it 4 more and then going to contact my congresman's immigration specialist to see if they can help. I know of no reason for it. It is the second K-1 for both me and my fiancee (not to the same person). I am guessing they are checking to see what happened on her last K-1 which she stayed here for 30 days and returned home well ahead of the 90 day period she was allowed. Other than that we have a clean slate.

12/14/2006 Applied for K-1 with request for Waver for Multiple filings within 2 years.
Waiting - Waiting - Waiting
3/6 Called NVC file sent to Washington for "Administrative Review" Told to call back every few weeks. 7/6 Called NVC, A/R is finished, case on way to Moscow. YAHOO!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
7/13 On Friday the 13th we see updated Moscow website with our interview on 9/11 (Hope we are not supersticious) 9/11 Visa Approved. Yahoo.
10/12 Tickets for her to America. I am flying to JFK to meet her there. 12/15/07 We are married. One year and a day after filling original K-1
12/27 Filed for AOS, EAD & AP 1/3 Received all three NOA-1's 1/22 Biometrics 2/27 EAD & AP received 4/12 Interview
5/19/08 RFE for physical that she should not have needed. 5/28 New physical ($ 250.00 wasted) 6/23 Green Card received
4/22/10 Filed for Removal of Contitions. 6/25 10 Year Green Card received Nov, 2014 Citizenship ceremony. Our journey is complete.

Three month ! Congressmen can not help at this stage. It will take however long

they want it to take. No info on specifics is given other than we are being "investigated

in the fraud prevention unit " and there is no time frame when the case will be

completed. :angry:

Well, I wish you the best of luck with it and I hope the congressman provides some help for you. It is hard to make plans when there is so much uncertainty. I have been trying to visit my fiancee every 6-8 weeks and hoped to time the next visit to be there when she has her interview even though I am not allowed in. Right now it looks like I will have more trips to see her than I hoped.

I am sorry it is ruining your plans and I hope it just turns out to be a bump in the road for both of us.

I have not done a congressional inquiry at this time as it is fruitless to do so.

I will after 6 month but it will still not change anything. When you hear a very loud

and happy scream....it will be me and we will be out of AP :) can't wait to post

it !

I don't see why any of you are delaying in contacting the congressmen. They can't hurt your cases; they can only help. You don't have to promise to vote for them or anything; they've already been elected, and they're public servants. I haven't had to deal with AR--thank God--but contacting my congressmen resulted in an almost immediate positive impact in my case and sped things along tremendously.

Turboguy: your problem likely has to do with the country of your fiancee. Unfortunately, it seems that Russians are scrutinized excessively. There are some horror stories out there about how long some Russians have been under AR. I'm so sorry this has happened to you and hope your case goes quickly.

Omoba: what a nightmere that you went into AR after the interview. I can only empathize with you. Do you suspect they're investigating you for possible marriage fraud? It seems there is a lot of prejudice out there against African women, that they are trying to enter the country fraudulently. And cases like Billyboy's don't help. :-(

Thanks for the encouragement and suggestions MMarlo. I am very active on a couple of busy forums for men who are seeking and married to Russian woman and have not seen very many talk about A/R. Perhaps that is it or perhaps because my fiancee was here on a K-1 once before they are checking more. Who knows. Some of the A/R cases I have seen were only a few weeks. Of course the record I have heard of the other way is 8 years. I will let them reach the two month mark and then decide if it is time to see if the congressman can help. Sure is frustrating and I feel bad for the others going through it.

Yes, there is frequent AP/AR in MENA and sometimes sub-saharan Africa after the interview.

I am the USC, my fiance is African. It is not common with European embassies, allthough it happens.

Researching the experiences from veteran VJ'ers no congressional inquiry or lawyer will help

at this stage in my fiance's case.

That is helpful during the USCIS stage or after a denial/ return to USCIS but not in our situation at this 3 month time frame.

I could initiate a FOIA request which can take a year to answer.

There have been others waiting much longer than I , in their second year.

There is nothing else to do but wait for now until the investigation is complete.

Each embassy has a fraud prevention team of a few people who investigate

documents or make field home visits etc.

Whenever they want they put someone under these investigations.

Most people have security or background or name checks, we don't seem to have those.

It is against their policy to give us details and specifics and we email them about every

3 weeks and I call DOS about every 2 weeks to ask if the case has been completed to make sure we don't fall between the cacks.

I have to say it really is a bad situation to be in. It is sort of a feeling like being in a hospital with two broken legs and two broken arms. All you can do is lay there and wait. You have no idea if it will be next week, next month, next year or next decade. Even if they said we are going to have you in A/R for two years then I would think about moving where she is so we could be together. I hope that we all get good news soon.

that's sure ture , you can't really plan on anything since you don't when it's coming. I am going back to China and live with her if it's not approved within half year. we will have kids there and everything, then I hope they will believe it's not a fraud or anything that they are investigating. hopefully, I am preparing for the worst of the worst, but aren't nobody breaking up this relationship..... keep going guys, hope we will be out soon...... I wish the NVC people read the posting here sometimes and understanding the suffering souls in this forum..

If we are not out of A/R in the next month I am moving there myself. I can't say I have much desire to live in the middle of Sibera but I also don't feel like being away from her either. I can live there and come back once a month for a week or 10 days to renew my visa and run my business. The whole A/R thing is stupid. Neither one of us has anything they should need to review and I am sure you don't either.

Your inquiry has been received at the NVC. The non-immigrant visa petition you mentioned in your letter has already been entered into our computer system and assigned the case number listed above.

As part of the aftermath of the events of September 11, 2001, there are additional security check requirements for visa applicants. While it is not possible to predict when the clearances for this case will be finished by all involved Washington agencies, please be assured that as soon as the results are received, the case file will be forwarded to the appropriate US Embassy or Consulate General.

What is Administrative Review?

Also, when we send our I129F to USCIS and they do all the checking and etc before approval, do they check on the petitioner? ( the us citizen) and what is the reason our documents are being transferred to the NVC after we already got our NOA2?

Sorry but after consulting with a few immigration lawyers, I found that the congressman can't influence the administrative processing much at all since it's an out of country issue. Pretty much the consulate has the final say and they seem to take however long they want to with AP process.

Sadly enough, there's no real way that you can speed up AP process especially with CP (AOS is different but I think that it can be more influenced). Found that out the hard way.
