Am sure K1 visa is treated as migrant visa when you are at d'consulate .. Cos the non immigrant are those going for short visit, schooling and biz.

After visa is approved this fee wld enable your green card to be issued when you arrive US by USCIS..

hi

you are wrong, the K1 is considered a non immigrant visa, because it only allows you to enter the country to marry within 90 days and then adjust status to get the GC

the $165 immigrant fee is to pay for the physical green card if you have applied for a GC, such as a spousal visa CR1/IR1

so far you only have applied to come to the US and marry your fiance, so no fee for the green card is necessary since you haven't applied for the green card yet, you will apply in the US after you are married and you don't have to pay the immigrant fee for the green card

hi

no one is fighting, you are incorrect and no payment is needed

the officer was incorrect to give you that since you are only doing the K1, right? you didn't apply for a spousal visa or you will have posted in the wrong forum

The K-1 is a special type of visa, in that it is a non-immigrant visa that has immigrant intent. It is processed through the immigrant visa units of the consulates for that reason, but it is still in fact a non-immigrant visa. You will not enter the US as an immigrant. You will need to file for adjustment of status after getting married within 90 days of entry via the K-1 in order to become a permanent resident and receive a green card.

K-1 visa holders do not pay the immigrant fee, despite whatever paper you may have been handed.

The following groups do not have to pay the USCIS Immigrant Fee:

  • Children who enter the United States under the orphan or Hague adoption programs;
  • Iraqi and Afghan special immigrants;
  • Returning lawful permanent residents (SB-1s); and
  • K nonimmigrants.

Hello

I believe RJM3 is referring to the visa issuing fee, this payment is done online and before documents checklist is sent to the U.S. Embassy besides filling DS-160.

In switzerland it's almost 300 Francs.

I don't see what other payment could be for the K1.

:)

You can read again through the thread. They already have their visa and were not talking about the visa processing fee, which is $265. They were asking about paying the $165 immigrant fee, which a K-1 does not pay. I posted the link to the site about the immigrant fee and the K visa exemption above.

Thank you KayDeeCee :)

I thought they were talking about the visa fee.

I'm new to VJ and to all the process involving the K1 visa. It still gets a bit complicating, lol.

Learning though :)

Thanks :)
