Hi everyone!

I need some urgent information, please!

I have been living in Italy since 2005, but my birth place is in Romania. Me and my fiancé are planning to get married the next year so we want to start the k1 process. I prepared everything, I obtained already the free marriage statement document from my country, Romania. I am confused if I have to obtain one from Italy too. I asked the city hall where I live if there is possible to have one and they said no. I don't know what to do.

My fiancé went to a lawyer and he requested my birth certificate and its legal translation, g-325form, letter of intent to marry, evidence of relationship, pictures of me and this free statement of marriage certificate. Probably they want me to send everything in advance so they have all there already

And I hope it was the G-325a form

I don't know if the name of the document is the right one, but it is the document which shows that I am free to marry someone, and that I have no other marriage.

Like I said never heard of it used in this package on this forum and definitely not when you are from EU.

But maybe some other members will help you.

The Certificate of Marriage Eligibility is typically required if you plan to marry in your country of residence, and then start the process for an IR/CR 1 visa, for the K-1 the letter of intent to marry serves this purpose for the US government. I would still hang onto the certificate for your interview just incase they ask, but it won't be needed for the initial filing of the packet.

Thank you Chris M.! I have been asked to send those documents by my fiancé's lawyer. Maybe it's an additional proof or in California the lawyers ask for that document, before filing the I129F form. I also prepared the letter of intent which they asked me to send, signed.

Despite the fact that a lawyer asked for it, it is not required for the I-129F petition. It also appears to not be required for a K-1 interview in Italy. Very few countries require a government document proving they are single in order to get a K-1 visa.

Thank you KayDeeCee! I was reading all the guides here and I didn't found anything about that document to be required. I will send the one I obtained in my birth country, translated and legalized, as they asked me.
