wow - suggest you start your own topic instead of hijaaking this one - living illegally in the UK is a huge problem when chasing a visa to the USA.

yes I google translate - and I know how awful it is. I do understand words in spanish I just cannot write or form sentences without help as I am just learning. So I had to rely on that. We had phone calls that were at length 20 mins some an hour or hour and half so they could see we were on the damn phone talking..

they only mentioned because of the emails to him. They asked how we speak and he said both spanish and english to each other.

again they did not tell him there were any other issues they even mentioned to him there was plenty of evidence for us - but they couldn't approve it because of the emails.. That is what they said to him - Freaking emails - are you KIDDING ME. This is stupid

I didn't want to marry in Cuba it is very expensive and then having to go through this again for another year... when they can say the same ###### because it's not like I will learn how to write in spanish over night.

so, are you submitting a new I-129F packet, front-loaded, this week or next? Yes? No? If no, why no ?

I am going to try it again - and add letters from friends and family who can vouch for us, and also send in some info pertaining to a wedding- that can't actually be planned yet but I can at least send the location, emails I've had with the people who work there, and a guest list. Then of course be present for the next interview.

I pray I don't get stuck again in TX as I see they are still way behind. I would like to get sent to California - because his medical expires in June and that cost $450. So I want to be approved before then and get him here before that expires.

We discussed getting married over there but the cost for that is very expensive, since documents need to be translated, notarized, sent to the consulate- approved and stamped, then the cost for the wedding, also my family,

So hopefully things will move along faster. and we will be approved.

Sorry to hear about the denial! But keep in mind if you go there for a future interview, you can't bring electronics into the Consulate. So no google translate. I think it would be very hard to have a relationship without speaking a common language, so I hope your Spanish classes go well.

A multiple waiver request is a simple sentence included in your petition :

I have filed a petition for ____ on ____ case number_____which was approved but refused and returned at the consulate

and, if needed, am requesting a multiple filing waiver for my current second petition for the same beneficiary.

Add a relationship timeline on how you met, how the relationship developed and how you communicate (attach all evidence).

I would strongly recommend to be there for the next interview if you choose to refile!

Is the US citizen even allowed to be there during the interview. In Turkey for example, I as the USC had to wait outside and couldn't go in.

I am sorry they denied your visa. I would refile with a lawyer, show up to the interview and take more Spanish classes even if you have to study alone using Rosetta Stone.

You might get more traction at the interview if your fiance was ACTIVELY studying English. This will be an indication that he is serious about the process. While you learning Spanish could not hurt your relationship, it will likely not impress anyone at the next interview.

When we filed, Olga's English was not fluent. I sent her several ESL books and she began a rigorous process of re-learning English. When Olga had her interview, I was not allowed to be with her so I cooled my heels on the sidewalk outside. Olga had the option to have her interview in Russian or English. She asked if she could try it in English. I can only assume that this earned her some points at the interview.

I did write a letter and added the first approval papers but I didn't use specific verbiage stating WAIVER. I guess I can mail it to them since I have a new NOA1. Right? or should I wait for the RFE?

It's for the same fiance and was refused at the interview not by USCIS so does that still require a waiver?

That we were denied based off the fact they thought it wasn't a bonafied relationship - because he doesn't know English very well and I wrote my emails using google translate - then I went on to add that he will be enrolled upon arrival in English courses - ( I added the school information and print out of the courses along with stating I have already contacted the school)

I also showed them my school transcripts for me learning to read and write better in Spanish.

I also stated that this time around I will be present for the interview because the last time I wasn't and they asked for me during the interview.

So you did not write that you "request a waiver for multiple filings" then yes, you should wait for the RFE.
