Visa to marriage time limit (merge threads)

Hello everyone,

So we are just about ready to book the medical in London.

Someone here told me that your visa (if approved) is valid for 6 months after the medical. (not the approval date?)

Is this the date you need to be married by, or just the time you have to travel to the US, where you have 90 more days to get married?

For example we were hoping on scheduling the medical for the very end of December.

The date we have set for the wedding is the end of July.

Will this work if he comes to the US in early June? July is 7 months from when we want to have the medical.

The visa should be valid 6 months from the date of the medical exam, not the interview/approval date

The 90 days to getting married starts when you fiancee enters the U.S.

Most place I am looking say it's the issue date. Which makes more sense because of you get stuck at a high-traffic embassy that schedules you interview months later than your medical, you would be at a severe disadvantage.

Sorry I can't seem to edit my earlier post but I found this directly on the US Department of State Website where it says it's valid from the date of issuance, not the medical.

The visa expiry date, which was 6 months from the medical.

The guy was mumbling something about "now you have 90 days, actually less than 90 days ...", and I thought, let him mumble, of course I have 90 days. And only later did I realize that he had put that date on my I-94 stamp.

London will issue your visa to expire 6 months from your medical date. It wasn't always this way. The TB clearance done at your medical exam is only valid for 6 months. So you have to enter the U.S. while your medical clearance is still valid. If the consulate holds up your visa for some reason, you would have to go back to Knightsvridge clinic and pay again to renew your medical clearance before they would issue your visa.

If you plan to marry at the end of July, then don't enter the U.S. until around the first of May. Don't rush to book your medical so soon.

From the date of medical.....despite what that says. The date of issuance on the visa will be the medical complete date......not the date the embassy issues it. Yes in many places that are backed up people have to go redo medical after their interview. You can research, ask, and dispute the point all day long.....but it's from the medical completion date. With that being said, you can enter the U.S. on the date of your expiration and still have 90 days to marry, because the K-1 visa does give you legal status in the U.S. like other visas...it is canceled at the port of entry and marked through in the passport. The I-94 is the legal document for the next 90 days...

Yep it's date from Medical. My fiance had his medical done on August 18th, his visa expires Feb 18th, 2016, his visa was issued Nov 9th.

So he could enter on Feb 17th, and then it would start the "90 days to get married". The 90 days to marry doesn't start until the visa is used at entry.

So, the K-1 visa in my passport explicitly states "VISA SHORTENED DUE TO MEDICAL VALIDITY". (Frankfurt) The time between medical and issuance of visa is subtracted from its validity. For me, that was around 3 weeks.

And, to repeat, no matter if you theoretically have 90 days to get married, if the ignorant IO puts another date on your I-94 - in my case 7 NOV rather than 15 DEC - you can dispute it or live with it ... the I-94 matters.

In my case, thus, the marriage time limit actually was the visa validity limit. Luckily I didn't enter the US on the last day of my visa validity!

I'm really glad I came on here to ask about the medical/issuance date thing. I would not have known otherwise and would have just taken what the DOS website said!
