I am a US Citizen, and my girlfriend of 2 years lives in Brazil. We will be engaged soon. She has a tourist visa. If during one of her visits here we get legally married in the USA, then she returns home is that a problem? When she does return home she is considered an "Immediate Family Member". So at that time I could then file Form I-130 Petition for Alien Relative and my (now wife) can go through consular processing, await approval of I-130, then go to her interview at the Rio US Consulate. Is this correct? Just want to double check. Thanks for your help!

That is no problem at all...that is what my husband and I did. He came to US, we got married and he went back home while I filed the I130.

Hi,

I got married using my B2 in January in the US, returned to Brazil, and one month letter we sent the CR-1 petition.

We got approved on November 6, so the entire process lasted 8.5 months.

Thanks for your help. After looking into it, I think Im going to go through the process with the Fiance Visa so she can just stay here while we process her citizenship papers. While that is being processed, is it true that she is not allowed to return back to Brazil and re-enter the US? She is in a PhD program and while here she will work on her thesis paper but will have to go back to present it. Do we have to wait until she is considered a US citizen before she tried to re-enter the country? If so, when she goes back to Brazil will she be allowed back into Brazil as a Dual Citizen or will she need a tourist visa like the rest of the US? Thanks again for your help!

Does Brazil offer and/or recognize dual-citizenship? I don't know. Enter using her Brazilian passport.

K-1 fiancé visa to citizenship is about a 3-4 year journey. You sound like you have not done the appropriate research. I suggest you start with the 'guides' at the top of the page.

There is no citizenship at this point. That's a long way away, think 4 - 5 years.

K-1 visa allows her to enter the U.S. once.

After you get married, you'll file for adjustment of status from K-1 to Permanent Resident.

Once she is a permanent resident, she can go to Brazil and re-enter the U.S. as much as she likes.
